From: D A French [mailto:[email protected]] Sent: 17 July 2009 20:10 To: [email protected] Subject: Re: ILA Committee on The Legal Principles relating to Climate Change Dear Professor Murase I have now had a chance to read the report and may I commend the Japanese Branch for an excellent contribution - the ideas / suggested lines of equiry have left many interesting thoughts as to where the Committee may go. Personally, I was particularly struck by two ideas: : the notion of bona fides as a (secondary) legal obligation within the climate change regime : the different strands of the role of equity in implementing the post-2012 climate change regime - utilisation of carbon, burden-sharing, distribution of entitlements under emissions trading regime etc. Moreover, the structural questions surrounding the post-2012 architecture (both how different prospective legal instruments might interrelate with each other) as well as the "future" of the UNFCCC and Kyoto all indicate to me some real challenges ahead. best wishes Duncan -------------------------Dr Duncan A.
