Zofran Lawsuits | FAQs
What is Zofran? Zofran (odansetron) is an anti-nausea/vomiting
medication. It is classified as a Serotonin-3 Receptor Antogonist. The
Food & Drug Administration originally approved it in 1998.
What is it used for? Zofran was approved for and is prescribed to
treat cancer patients suffering from nausea/vomiting induced by
treatments such as chemotherapy.
What are some of the adverse effects? Scientific research has
concluded there is a link between children born with birth defects
and mothers who used Zofran in the first trimester of pregnancy.
Multiple studies appear to confirm the increased risk including a
2012 report from the CDC that indicates women are at two-fold risk
of birthing a child with cleft palate when using Zofran in the first
trimester. A similar study showed a 30% risk of congenital heart
defects under the same conditions, the mothers’ first trimester use.
Who is liable and why? The pharmaceutical company that
developed Zofran, GlaxoSmithKline(GSK). GSK was actually sued
in 2012 by the Department of Justice for illegally promoting drugs
for “off-label” use. Zofran was part of that lawsuit which included
GSK paying kickbacks to doctors for prescribing it. Zofran was never
approved for pregnant mothers. Additionally, there were no studies
done to test its effects on a developing fetus.
How many lawsuits have been filed? At this time only a handful.
However, considering the estimation that Zofran is prescribed
to roughly 1 million pregnant women the number of lawsuits is
expected to increase substantially.

a deadline for filing lawsuits. This deadline is known as the statute
of limitations, which in certain states is one year from the date of
the injury.
