Most Email Marketing From Legitimate Companies Violates US
Federal Law, Free Online Email Marketing Legal Resource Seeks to
Help Marketers Comply
Chicago, IL (16 December 2004) - The US CAN-SPAM Act became a federal
law in 2004, yet numerous studies reveal that the majority of email
marketing sent by legitimate US companies violates this law. Even more,
additional federal and state laws related to online privacy and marketing may
that also be applicable to a company’s email marketing may be overlooked.
In addition to US laws, email marketing- related laws now exist in nearly
every nation and emails sent from US companies to recipients in other
countries may be violating laws in these countries as well. As a company’s
customers – and the public – become increasingly savvy about these laws, a
company’s violations of federal law not only create legal liability, the create
brand liability. Legal violations can negatively impact a company’s public
image.
According to marketing expert and publisher of MarketingToday.com Peter
DeLegge, “There is a misconception among legitimate marketers that the US
federal CAN-SPAM law does not apply to them. They often incorrectly believe
this law only applies to spammers and pornographers. In actuality, this law
applies to every company and everyone who engages in email marketing,
whether it is e-commerce or a company newsletter. Even more, compliance
isn’t very difficult. There is a real need for education in this area. That is
what motivated the creation of this resource.”
