Provisional translation Ordinance for Enforcement of Domestic Animal Infectious Diseases Control Law (Excerpt) (Ordinance of the Ministry of Agriculture and Forestry No. 35, May 31, 1951) <Reporting and notification of inspection status and results> Article 20 1. Prefectural governors shall prepare a monthly report on the status and results of all measures taken in the month for prevention of specified diseases or monitored infectious diseases and submit it to the Minister of Agriculture, Forestry and Fisheries using the appended Form 14 before the 10th of the following month. 2. Prefectural governors shall prepare an annual report on the status and results of all measures taken in the year for prevention of specified diseases or monitored infectious diseases and submit it to the Minister of Agriculture, Forestry and Fisheries using the appended Form 14-2 before the 31st of January of the following year. 3. Prefectural governors shall report the status of implementation to the relevant prefectural governor(s), without delay, upon issuing their orders to owners of domestic animals for: inspection by an animal health inspector under the provision of Article 4-2, paragraph (3) or paragraph (5) of the Act or Article 5, paragraph (1) of the Act; injection, dipping or medication by an animal health inspector under the provision of Article 6, paragraph (1) of the Act; or implementation of a method of disinfection, a method of cleaning or a method of exterminating rodents, insects, etc, under the provision of Article 9 of the Act. <Standards of Rearing Hygiene Management> Article 21 The Standards of Rearing Hygiene Management in Article 12-3, paragraph (1) of the Act shall be specified as follows. 1 i) Perform periodic cleaning or disinfection of animal quarters and instruments, and keep domestic animals, work clothing and shoes clean. ii) When entering and exiting animal quarters, take necessary measures, such as disinfection of hands, work clothing and shoes, to prevent transmission of infectious disease agents of domestic animals. iii) Avoid, whenever possible, contaminating the animal feed and water with excreta of domestic animals, rodents, wild birds and other wildlife animals. iv) When introducing new domestic animals from other farms or facilities, isolate the animals from other domestic animals, in order to prevent transmission of infectious disease agents of domestic animals, until it is confirmed that the introduced animals are free of health concern. v) Restrict a person from entering the animal quarters, if he/she has visited other farm(s). Disinfect vehicles that have entered other farm(s) before allowing entry into the facility. vi) When a roof or a wall of the animal quarters is damaged, repair the damage, without delay, while protecting the windows and entrance with a net or other protective equipment against incursion of wildlife animals, such as rodents and wild birds, and pests, such as flies and mosquitoes. If necessary, take an appropriate control and extermination measures against these animals and pests. vii) When releasing a domestic animal to other farms, examine the health status of the animal in order to prevent possible transmission of infectious disease agents of domestic animals through the transportation of the animal. viii) Maintain the health of domestic animals through good husbandry practices in order to allow the earliest possible detection of abnormalities in the animals. Ask for veterinary advice or examination, if necessary or whenever an abnormality is found. ix) Do not keep domestic animals in overcrowding facilities that may negatively affect the animal health. x) Update the knowledge about prevention of emergence of infectious diseases in domestic animals. <Notification of affected animals> Article 22 Notification under the provisions of Article 13, paragraph (1) of the Act, written or oral, shall include the following information: i) Name and address of the person reporting; ii) Name and address of the owner; 2 iii) Type of the infectious disease concerned and category of the affected domestic animal(s) or domestic animal(s) suspected of being affected; iv) Type, sex and age of the affected domestic animal(s) (including dead domestic animals; If age is not known, provide estimated age); v) Location of the affected animal(s), animal(s) suspected of being affected or their carcass(s); vi) Date of finding and description of condition at the time of finding; vii) Estimated date of disease onset; and viii) Other relevant information. <Public notice of the disease incidence> Article 24 1. Public notice pursuant to Article 13, paragraph (4) or paragraph (5) of the Act shall include the following information for each of infectious disease types and domestic animal species: i) Category and number of the affected animal(s) or animal(s) suspected of being affected; ii) Location or area of disease incidence; iii) Date of incidence; and iv) Other relevant information. 2. The provisions of Article 8 shall apply mutatis mutandis to public notice prescribed in the preceding paragraph. <Notification and reporting> Article 25 Notification prescribed in Article 13, paragraph (4) of the Act, except those to the relevant prefectural governor(s), shall be made by telegraph, telephone or an equivalent method when reporting domestic animals listed in the following categories (i) and (ii) and by post or an equivalent method when reporting domestic animals listed in the following category (iii) and shall include the information specified in Article 22 of this Ordinance. i) Domestic animals contracting or being suspected of having contracted rinderpest, contagious bovine pleuropneumonia, foot-and-mouth disease, infectious encephalitis, vesicular stomatitis, Rift Valley fever, hemorrhagic septicemia, glanders, African horse sickness, classical swine fever, African swine fever, swine vesicular disease, fowl cholera, highly pathogenic avian influenza or Newcastle disease 3 ii) New cases of affected animals or animals suspected of being affected other than those listed in (i) iii) Affected animals or animals suspected of being affected other than those listed in (ii) 2. Notification to the relevant prefectural governor(s) prescribed in Article 13, paragraph (4) of the Act shall be made monthly before the 10th of the following month using the appended Form 15. In addition, on receiving notification under the provision of Article 13, paragraph (1) of the Act, involving domestic animals listed (i) and (ii) of the preceding paragraph, notification shall be made by telegraph, telephone or an equivalent method as well. 3. Notification prescribed in Article 13, paragraph (4) of the Act shall be made monthly before the 10th of the following month, without delay, by telegraph, telephone or an equivalent method using the appended Form 15. <Restriction on outward movement of domestic animals> Article 41-2 1. The Ministry of Agriculture, Forestry and Fisheries shall issue a public notice where accessible by the public on the following information, when prohibiting or restricting the outward movement of domestic animals under the provision of Article 32, paragraph (2) of the Act i) Description of prohibition or restriction ii) Period of prohibition or restriction iii) Designated areas for prohibition or restriction iv) Designated domestic animals, carcasses or commodities thereof for prohibition or restriction 2. The Ministry of Agriculture, Forestry and Fisheries shall immediately notify the relevant prefectural governor(s) upon the issue of outward movement prohibition or restriction order under the provision of Article 32, paragraph (2) of the Act. <Designated biological preparations for animal use> Article 57 Biological preparations for animal use designated by the Ministry of Agriculture, Forestry and Fisheries in Article 50 of the Act shall be specified as follows: 4 i) Biological preparations for animal use that are not listed in Japanese Pharmacopoeia and are not approved under the provisions of Article 14, paragraph (1) or Article 192, paragraph (1) of the Pharmaceutical Affairs Law; or ii) Vaccine preparations against rinderpest, classical swine fever and highly pathogenic avian influenza, tuberculin, mallein and johnin. <Persons not eligible for allowances> Article 60 Persons specified by the Ministry of Agriculture, Forestry and Fisheries in the proviso of Article 58, paragraph (1) of the Act shall refer to those who have failed, against the provisions of the Act, orders pursuant to the Act or any other relevant animal health regulations or dispositions thereof, to take necessary measures to prevent outbreak or spread of the relevant domestic animal infectious disease and have caused outbreak or spread of the domestic animal infectious disease to which allowances are applicable. <Appraisers> Article 61 Appraisers described in Article 58, paragraph (4) of the Act shall consist of those selected from each of the following categories: animal health inspectors; local government officials who are engaged in animal husbandry administration, and other individuals experienced in animal husbandry practices (one or more individuals shall be selected from each category). <Calculation of allowance amounts> Article 62 Allowance amounts specified by the Ministry of Agriculture, Forestry and Fisheries under the provisions of Article 7 of the Cabinet Order shall be calculated according to the following categories and subcategories. i) Poultries: A sum of the following amounts, provided that the amounts specified in (b) and (c) are covered only if they are found necessary in general practices. a) The average market price of poultries equivalent to affected poultries (i.e., poultries that have been: restricted from shipment; owned by an individual who has followed the order of prohibition or restriction of movement or outward movement issued under the provisions of Article 32 of the Act [hereinafter referred to as “specific movement restriction”]; and scheduled to be shipped during the period of specific movement restriction. The same shall apply hereinafter.) on the day when shipment of the affected poultries has been 5 scheduled, subtracted by the average trading price of affected poultries and then multiplied by the number of affected poultries b) Actual feed costs spent between the day of scheduled shipment and the day of actual shipment of affected poultries c) Actual expenses spent for incineration, burial or rendering of affected poultries that have been culled by necessity ii) Poultry eggs: A sum of the following amounts, provided that the amounts specified in (b) to (d) are covered only if they are found necessary in general practices. a) The average market price of poultry eggs (i.e., eggs produced by an individual who has followed specific movement restriction, and restricted from shipment during the specific movement restriction period) equivalent to affected poultry eggs over the specific movement restriction period, subtracted by the average trading price of the affected poultry eggs and then multiplied by the number of affected poultry eggs b) Actual expenses spent for storage and cargo handling of the affected eggs at the storage facility c) Actual expenses spent for transportation of the affected eggs to the storage facility d) Actual expenses spent for incineration, burial and rendering of the affected eggs that have been disposed by necessity. 6
