HAWAII ORGAN DONOR LEAVE POLICY

Employees in Hawaii
Overview
Effective July 3, 2014, the State of Hawaii enacted the Hawaii Donor Leave Act SB 1233. The act allows
employees to take leaves of absence for organ, bone marrow, or peripheral blood stem cell donation.
Employers shall not discharge, fine, suspend, expel, discipline, or in any other manner discriminate
against an employee who exercises a right provided under this chapter; or opposes a practice made
unlawful by this policy.
Employees are eligible for a leave of absence not exceeding:
1. Seven days each calendar year to serve as a bone marrow or peripheral blood stem cell donor;
2. 30 days each calendar year to serve as an organ donor;
3. The leave may be taken in one or more periods, but shall not exceed the amount of leave
outlined in 1 and 2 above.
Kelly Services, Inc., and/or its subsidiaries, (“Kelly.” “Kelly Services”) may require the employee take up
to three days of earned but unused sick leave, vacation, or paid time off, or unpaid time off, for bone
marrow or peripheral blood stem cell donation; and up to two weeks of earned but unused sick leave,
vacation, or paid time off, or unpaid time off, for organ donation.
Any period of time during which an employee is required to be absent from work to serve as an organ
donor, bone marrow donor, or peripheral blood stem cell donor shall not constitute a break in the
employee’s continuous service for the purpose of the employee’s right to salary adjustments, sick leave,
vacation, annual leave, or seniority.

During any period that an employee takes leave, Kelly shall maintain and pay for coverage under
a group health plan, if applicable to the employee, for the full duration of the leave, in the same
manner as the coverage would have been maintained if the employee had been actively at work
during the leave period.
Persons Affected
All Kelly Corporate, Field, and Temporary Employees working in Hawaii.
Requirements

The individual must be employed with Kelly Services for at least one year immediately preceding
the commencement of leave.

The employee shall submit written verification to the employer of the medical necessity.
Remember to keep any documentation regarding the leave or medical information in a separate
medical file, not the personnel file.
Documentation
It is important to document unpaid leave taken by employees, should Kelly need to provide proof of
compliance at a future date. Kelly Representatives, document in the following manner:


For Temporary Employees – Document the number of hours and date(s) the employee will
use unpaid leave in KSN. Do not list the medical reason for the leave.

From the Talent or Order Details screen, click Add Comm; the Communication
Details screen displays.

From the Communication Details screen, as the Type, choose Talent Management.
As the Reason, choose Leave of Absence. Add detail (the number of hours and the
date[s]) in the Resolution/Note section.
For Regular Employees – Document unpaid leave in the employee’s file.
