INSTRUCTIONS
Re: Regulating and strengthening state management of land.

In past years, the state management of land in the province has gained positive
changes. The land allocation, rent and change of land using purpose have been implemented
under the land use planning and schedule approved by competent authority; the issuance of
the certificates of land use right, house and land-based property ownership, the control,
inspection of execution of the Law on land have been implemented regularly, this contributes
order of land management and effect of land use.
However, in some areas, the change of land using purpose has not been implemented
under the regulation, especially the change of land using purpose from paddy field land to
non-agricultural land; the land encroachment has occurred in many localities; the issuance of
the certificates of land use right, house and land-based property ownership has not gotten
result as required; Land document has not been updated and amended regularly, therefore it is
difficult for land management, issuance of the certificates of land use right and land clearance.
To promptly overcome shortcomings and violations of land management and using,
the Provincial People’s Committee instructs:
1. To check up legal normative documents on land:
- Department of Natural Resources and Environment presides over and co-ordinates
with related departments, branches to check up documents promulgated by the Provincial
People’s Committee on land, land cost, land compensation, support and resettlement when the
State implements land acquisition; proposes to abrogate inappropriate regulations, to amend,
add or promulgate new documents to implement the land law being appropriate to actual
situation in the province.
- Department of Finance presides over and co-ordinates with Department of Natural
Resources and Environment, related departments, branches to check up documents
promulgated by the Provincial People’s Committee on financial regulation; proposes to
abrogate inappropriate regulations, to amend, add or promulgate new documents to
implement the land law being appropriate to actual situation in the province.
- Provincial Department of Taxation presides over and co-ordinates with related
departments, branches to check up documents promulgated by the Provincial People’s
Committee on tax policy, profile transfer to implement financial obligations; proposes to
abrogate inappropriate regulations, to amend, add or promulgate new documents to
implement the land law being appropriate to actual situation in the province.
2. To promote propaganda, dissemination of the land law:
- To continue propagandizing, disseminating the land law and documents on guidance
for officials and peoples of the province to know and implement.
- Department of Justice presides over and co-ordinates with Department of Natural
Resources and Environment, Thai Binh Newspaper, Radio and Television, Portal and related
units to regularly propagandize, disseminate the land law by practical content, and methods
being appropriate to people and actual situation in the province.
