You asked us:
I am asking in relation to Delayed Transfer of Care (Mental Health Facility only) to leave
the NHS Statistics. Each Health Board collects/checks statistics in conjunction with each
Local Authority Social Services Department. Your organisation should hold the following
breakdown of these statistics, I have got these from the new codes by stage of delay and
principal reason for delay

Our Response:
Some of this information is already routinely published and is therefore exempt from
disclosure under Section 21 – Information Accessible by other means. In our duty to

We have also been able to provide a further breakdown of the information requested in the
embedded document. However, please note that due to the low numbers involved we are
unable to provide you with the monthly ( * and in some cases the individual yearly) level of
detail you are seeking due to the potential risk of identification. To release the low figures
broken down by month, with the individual reason for the delay specific to Mental Health
facilities, could be linked with other information available in the public domain, we are
therefore withholding this detail under Section 40(2) of the Freedom of Information Act
2000. This information is protected by the Data Protection Act 1998, as its disclosure
would constitute unfair and unlawful processing and would be contrary to the principles set
out in Schedules 2 and 3 of the Act.
Section 40 is an absolute exemption and does not require the Health Board to consider the
public interest test.
In reaching this decision the DPA defines personal data as data which relates to a living
individual who can be identified solely from that data or from that data and other
information which is in the possession of the data controller. As responses under the
Freedom of Information Act are to the public at large, the Health Board considers that an
individual could be identified if this was released together with other information which may
be available in the public domain.
