States in the Federal System
GOVT 2305, Module 3
Full Faith and Credit Clause
The Full Faith and
Credit Clause is the
constitutional provision
requiring that states
recognize the official
acts of other states, such
as marriages, divorces,
adoptions, court orders,
and other legal
decisions.
Before 2015
Privileges and Immunities
The Privileges and Immunities
Clause is the constitutional
provision prohibiting state
governments from
discriminating against the
citizens of other states.
Extradition
Extradition is the return from
one state to another of a person
accused of a crime.
Independent State Powers
The advocates of
states’ rights believe
that the 10th
Amendment protects
the rights of states
against federal
power.
In practice, the 10th
Amendment has not
been a major barrier to
the growth of federal
government authority. It
DOES NOT trump the
national supremacy
clause.
Concurrent and Reserved Powers
Concurrent powers
are the powers of
government that are
jointly exercised by the
national government
and state governments.
Reserved powers are
the powers of
government left to the
states.
