Madison? Marbury vs Madison • When the Secretary of State did not appoint Marbury as Justice of the Peace he sued the government. The supreme court made the decision if the law was constitutional or not. Thus giving the Supreme Court the power of Judicial review. 40.What is judicial review? It allowed the US Supreme Court to determine if a law passed by Congress was unconstitutional. Thus creating Judicial Review.
