PRODUCT LIABILITY RELEASE AND DISCLAIMER
I, on behalf of myself and my heirs and assigns (the “Releasing Party,” “I,” “me” “my” or “mine”),
hereby waive, release and forever discharge Extreme Products LLC., its affiliates, and their officers,
directors, employees, agents, successors and assigns (each, an “Released Party” and collectively, the
“Released Parties,” “you” or “yours”) from and against any and all fault, responsibility, liability or
obligation for claims, causes of action, costs, expenses, liabilities, personal injury or disability, injury to
the ear or hearing loss or impairment and damages of any kind and nature, whether known or unknown, at
law or equity (including reasonable attorneys’ fees, penalties or interest) ( collectively a “Claim”)
suffered, sustained, incurred or required to be paid by any Releasing Party arising out of, resulting from
or relating in any way to my participation in any custom fit ear impression conducted by the Released
Party and activities associated therewith (the “Event”), in my use of the custom ear impression or a device
resulting there from, my use or operation of any custom ear mold product, active or passive hearing
protection product, in ear monitor or a similar device provided to me by you, or my use of third-party
audio ear products (such as headsets, ear buds and similar products). I further agree that no Releasing
Party or anyone else seeking contribution or indemnity under any statute or contract will ever sue any
Released Party with respect to any Claim.
ANYTHING TO THE CONTRARY HEREIN NOTWITHSTANDING, UNDER NO
CIRCUMSTANCE SHALL ANY RELEASED PARTY BE LIABLE TO ANY RELEASING
PARTY AND ALL RELEASED PARTIES HEREBY DISCLAIM ANY LIABILITY FOR
ANY CLAIM, PERSONAL INJURY, INJURY TO THE EAR OR HEARING LOSS OR
IMPAIRMENT THAT IS IN ANY WAY RELATED TO THE EVENT OR MY USE OR
OPERATION OF ANY PRODUCT PROVIDED ME BY ANY RELEASED PARTY AND
FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES, LOSS
OF INCOME, GOODWILL OR BUSINESS PROFITS, OR EXEMPLARY OR PUNITIVE
DAMAGES. THE RELEASED PARTIES MAKE NO EXPRESS WARRANTIES AND
DISCLAIM ANY IMPLIED WARRANTIES OF ANY KIND, INCLUDING, BUT NOT
LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR
A PARTICULAR PURPOSE. This limitation applies regardless of the form of action, whether the
damages or other relief sought are based on breach of warranty, breach of contract, tort (including
negligence), strict product liability, or any other legal or equitable theory even if the relevant party has
been advised of the possibility of such damages. This limitation does not apply to claims for personal
injury caused by the intentional or willful misconduct of a Released Party.
I fully accept and assume all risks and all responsibility for losses, costs and damages I incur as a result of
my participation in the Event or use of the products noted above. I certify that I have read this Release,
fully understood that I have given up substantial rights by signing this Release and have signed this
Release freely of my own will and accord. I confirm that the information I have provided is correct
