Application of Plan
This plan applies to all employees, contractors and guests of the Pet Porpoise Pool Pty Ltd
trading as Dolphin Marine Magic (DMM). This policy is to be read in conjunction with
2015 Incident Report and Investigation Procedure
2015 Emergency Evacuation Policy and Procedure
2015 Emergency Management Policy and Procedure
Purpose of Plan:
1. To prepare for and improve the management of any pollution incidents occurring at
the Pet Porpoise Pool site and to facilitate better co-ordination with relevant
response agencies.
2. To comply with new requirements of Protection of the Environment Legislation
Amendment Act 2011 (POELLA) Part 5.7A to prepare, keep, test and implement a
pollution incident response management plan.
Definition of a “pollution incident”
Pollution incident means an incident or set of circumstances during or as a consequence of
which there is or is likely to be a leak, spill or other escape or deposit of a substance, as a
result of which pollution has occurred, is occurring or is likely to occur. It includes an incident
of a set of circumstances in which a substance has been placed or disposed of on premises,
but it does not include an incident or set of circumstances involving only the emission of any
noise.
A pollution incident is required to be notified if there is a risk of “material harm to the
environment” which is defined in section 147 of the POEO Act as:
a) harm to the environment is material if:
i)
it involves actual or potential harm to the health or safety of human beings
or to ecosystems that is not trivial or

it results in actual or potential loss of property damage of an amount, or
amounts in aggregate, exceeding $10,000
Description and Likelihood of hazards
Potential hazards include

Storage of hazardous substances on site and the potential failure of containment
tanks. This could lead to
1. Uncontrolled release of hazardous substances into the environment.

Liquid Chlorine - Up to 4250 ltrs
LP gas - Up to 600 ltrs
Paint solvents / thinners - Up to 20 ltrs

Pre emptive actions
Liquid Chlorine: As per regulations, the liquid chlorine tanks are designed with bunded areas
to contain any spills onsite. Any small spills are contained into the specific area and can be
cleaned up with appropriate spill kit containing chlorine neutraliser. There are also detailed
procedures in place and appropriate PPE to ensure staff use liquid chlorine safely.
In the Event of an Incident involving Liquid Chlorine:
There are a number of ways a major liquid chlorine spill could occur
1. Bund and tank rupture
2. Vandalism where chlorine could be drained out of tank
3. Natural disaster
There are two types of major liquid chlorine spills that could occur
1. On site : where all the spillage is controlled by the bund system
2. Off site: where the spillage flows onto adjoining properties and/or creek
In the event of a major spillage or contamination to personnel, the following procedure
should be followed
1. The area must be evacuated at once
2. Consult with the CEO and WHS Co-ordinator on the MSDS of liquid chlorine if
applicable
3. Treat any persons that may be contaminated by washing in large amounts of water
and removing contaminated clothing
4. Isolate the affected area by erecting a barricade to prevent other persons from
entering the area.
5. Sandbag main drain to prevent run off into stormwater
6. Staff who have been trained to deal with a situation are to
flush the area with fresh water and apply neutraliser as necessary
7. Normal work must not be resumed until the WHS co-ordinator is satisfied that it is
safe to do so.

In the Event of a major gas leak
In the event of a major gas leak, the evacuation procedure needs to be followed immediately
1 Ensure your own safety. Alert the senior manager to the incident of a
major gas leak.
2 Senior manager to assess the incident and alert CEO who will activate the evacuation
siren if necessary.
3 Turn off the gas at the main valve.

4 Alert emergency Services
5 When Emergency Services arrive the CEO and senior manager will explain the
situation to them.
6 Normal work must not be resumed until the CEO, Senior Manager and WHS Coordinator are satisfied that it is safe to do so.

In the event of a spill of Paint Solvents / Thinners
1
Ensure your own safety Alert the senior manager to the incident of a
spill of Paint Solvents / Thinners.

Evacuate the area and notify the CEO of a spill.
3
Contain spill and if necessary CEO will alert Emergency Services.
4
If only small cover area in absorbent material and ready fire Extinguisher.
Spill Procedures:
The major hazard of large spills is the potential release of hazardous concentrations of
flammable vapours. Therefore, in the event of a large spill of the material, (i.e., 4 litre
container), shut off any ignition sources.
If there is personal injury or a strong threat of personal injury, call emergency services on
000. Do not let anyone enter the spill area. Employees shall restrict access to the work area.
Small spills may be absorbed or wiped up using absorbent materials or paper towels. After
absorbing any excess liquid, clean-up materials should be placed in an approved metal
container with a self-closing lid.
Authority and Indemnity
During emergency situations or exercises, the responsible Emergency Response Personnel
(ERP) shall have authority to issue instructions to evacuate all persons from the site and/or
areas. Such instructions are to be adhered to at all times by all employees and visitors.
These personnel shall be indemnified against civil liability resulting from practice or
emergency evacuation of a site where personnel act in good faith and in the course of their
duties

Any incident causing destruction, loss of property, shut down or disruption of business
operations; CEO or Senior Manager to CALL EMERGENCY SERVICES if necessary. Notification
should include the type of incident, the exact location and details of any person or persons
who might be injured, in distress, or at risk.

The staff member seeing or receiving the news of an incident should immediately
contact the CEO. If the CEO is not available, then the Business Manager or most senior
manager on duty on the day should be contacted.
2.
The CEO or delegate will determine whether the incident is a critical incident as per
criteria under section 3 of this policy. When a critical incident is determined by the CEO or
delegate and emergency services have been called, the WHS committee will convene under
the directions of the CEO or delegate. The WHS committee will be responsible for the
formulation, implementation and management of the critical incident response and resource
allocation. The WHS committee will maintain relationships and liaise with other appropriate
external organisations. The WHS committee will consist of, but will not be limited to, the
following staff members:

Notification Protocol for Regulatory Authorities:
Regulatory authorities are to be contacted immediately when a pollution incident occurs.
The pollution incident is defined as:
“When material harm to the environment is caused or threatened and when the clean up
value will be more than $10,000.”
The authorities will be called in the following order:

Neighbours – residential and businesses within 100 mtrs of the

Maps of premises, location of potential pollutants, location of
stormwater drains to nearest watercourse and discharge locations –
(see attached diagrams) to be given to Emergency Authorities.

Staff training programme
Key staff are to be trained in procedures to deal with a liquid chlorine spill
1. How to sandbag stormwater drains to prevent run off into creek
2. How to flush with fresh water and apply neutraliser to the chlorine spill
All staff using liquid chlorine are to be trained on how to handle it safely at their induction
1. How to take liquid chlorine from the tank, taking care to turn the valve on and off
correctly
2. Using PPE when handling liquid chlorine.
Frequency of training
Training on these procedures is carried out
1. All employees and key staff initially received training as part of their induction
when commencing employment. Records of induction sessions are filed in each
employees files and on the WHS Advance system.
2. Training sessions on all emergency procedures are conducted regularly. The CEO
or WHS committee may organise simulated incidents of emergencies e.g. fire,
hold up, and chlorine spill during these training sessions. Records of training
sessions are kept on WHS Advance system.
3. Staff members are assessed on their knowledge of the incident management
procedure annually. Copies of assessments are held in employee files and on
WHS Advance system.
Making Plans available
A hard copy of the plan is available on the premises

2. In the staff lunch room
Electronic copies of the plan are available
1. in prominent position on website
2. will be provided free of charge to any interested party who requests it
