Amending Reg. 833 of R.R.O. 1990
(Control of Exposure to Biological or Chemical Agents)
Note: Regulation 833 has previously been amended. Those amendments are listed in the Table of Regulations – Legislative

1. Section 4 of Regulation 833 of the Revised Regulations of Ontario, 1990 is amended by striking out “but subject
to section 9” in the portion before paragraph 1.
2. Section 6 of the Regulation is amended by striking out “sections 7 and 9” and substituting “section 7”.
3. (1) Subsections 9 (2), (3) and (4) of the Regulation are revoked and the following substituted:
(2) Every employer using styrene-based polyester resin in conjunction with a fibrous reinforcing agent to make or repair
any goods, substance, article or thing, or part thereof, shall ensure that the exposure of workers to airborne styrene does not
exceed the time-weighted average exposure value and short-term exposure value set out in Part 4 of the Schedule.
(3) An employer described in subsection (2) may provide respiratory equipment to a worker to ensure the worker’s
exposure to airborne styrene does not exceed the time-weighted average exposure value and short-term exposure value set out
in Part 4 of the Schedule if,
(a) the time-weighted average exposure of the worker to airborne styrene is greater than 50 but less than or equal to 100
parts styrene per million parts of air by volume; or
(b) the short-term exposure of the worker to airborne styrene, measured over 15 minutes, is greater than 100 but less than
or equal to 200 parts styrene per million parts of air by volume.
(4) Every worker who is provided with respiratory equipment by an employer under subsection (3) shall use the
respiratory equipment.
(2) Section 9 of the Regulation is revoked.
4. Part 3 of the Schedule to the Regulation is amended by adding the following after the paragraph that begins
“The notation “skin””:
The notation “thoracic” following the name of an agent in this Schedule means that size fraction of the airborne particulate
deposited anywhere in the lung airways and the gas-exchange region of the respiratory tract and collected during air sampling
with a particle size-selective device that,
(a) meets the American Conference of Governmental Industrial Hygienists (ACGIH) particle size-selective criteria; and
(b) has the cut point of 10 microns at 50 per cent collective efficiency.
5. (1) Part 4 of the Schedule to the Regulation is amended by striking out,

(5) Part 4 of the Schedule to the Regulation is amended by striking out “*Special exceptions may apply to this
substance; see section 9 of the Regulation” at the end of the Table.
(6) Part 4 of the Schedule to the Regulation is amended by adding the following footnote:
(H) Respirable fibres: length greater than 5 microns; aspect ratio greater than or equal to 3:1 as determined by the
membrane filter method at 400-450 times magnification (4 mm objective), using phase-contrast illumination.

8. (1) Subject to subsections (2) and (3), this Regulation comes into force on the day it is filed.
(2) Subsections 3 (1) and 5 (3) come into force on March 1, 2006.
(3) Sections 1 and 2 and subsections 3 (2) and 5 (4) and (5) come into force on December 31, 2007.
