Care4All (The Service Provider) Navigo Extra (The Service Provider) North East Lincolnshire Clinical Commissioning Group (NELCCG) (The Commissioner) Pursuant to their agreement to responsibilities in care & support for individuals in residency in the Eleanor Apartments The agreement has no scheduled end date, but may be changed or terminated as described below. Rationale/Scope NAViGO is a Health and Social Care provider organisation for people with Mental Health issues. It has the delegated responsibility for micro-commissioning care packages for people with moderate to complex mental health needs. Focus Independent Social Work (Focus) have the delegated responsibility for micro-commissioning Social Care packages for adults with moderate to complex social care needs including those with Learning Disability. These are the Delegated Microcommissioners. NELCCG is the commissioning organisation with responsibility for ensuring appropriate and effective Health and Adult Social Care is in place for the people of North East Lincolnshire. Inclusion are the Landlords for the Eleanor Apartments, each apartment being a tenancy for the Individual. The nomination Rights for tenancy at Eleanor Apartments are delegated from The Commissioner to Navigo. Eleanor Apartments are a development of 12 apartments commissioned by NELCCG for individuals who are vulnerable through Learning Disability or Mental Health issues and require a level of Care and support that is over that of Supporting People but lower than that requiring Residential Care. The aim of the care within Eleanor Apartments is to maintain an optimal level of independence for each individual. The people who will reside at Eleanor Apartments will be nominated by the Delegated Micro-commissioner, who will identify outcomes with the individual to inform the development of a plan to meet their needs. This includes identifying the resources to support the tenancy and Care & Support package. The Care and Support for people who reside at Eleanor Apartments will be provided through an Individual Service Fund (ISF) model. These ISFs and the Care and Support for individuals will be organised and provided in a person centred way by Care and Support provider Care4All in partnership with Navigo Extra (The Service Providers). This document describes the agreement between The Commissioner and The Service Providers to deliver flexibilities in Care & Support provision for the Individuals tenanted in Eleanor Apartments, through an Individual Service Fund model. ISF AGREEMENT DRAFT ISF AGREEMENT DRAFT ISF AGREEMENT DRAFT ISF AGREEMENT DRAFT ISF AGREEMENT DRAFT ISF AGREEMENT DRAFT Goals and Objectives - To deliver flexible and personalised Care & Support to Individuals residing at Eleanor Apartments through an Individual Service Fund Model Definition of an Individual Service Fund (ISF) An ISF is a mechanism to deliver a Personal Budget. It is a managed account held by a third party with support provided in line with the persons wishes. The Agreement The North East Lincolnshire Clinical Commissioning Group (The Commissioner) and Care4All in partnership with Navigo Extra as Service Provider (The Service Provider) agree that: 1. People with mild to moderate Learning Disability or Long Term Mental Health Conditions placed at Eleanor Apartments in line with the Nominations Memorandum of Understanding between NELCCG and Navigo, will receive Care & Support through an Individual Service Fund Model. 2. The Service Provider will provide suitably qualified and experienced staff to support people in ways described in their support plans. This will require working in partnership with service providers with expertise in Mental Health and/or Learning Disability, underpinned by a formal agreement between the providers and with agreement of The Commissioner 3. The Service Provider may be required to work with other providers to deliver specialised skills or meet varied interests identified through the Assessment or ISF planning processes, for Individuals or groups of Individuals tenanted in Eleanor Apartments. The Service Provider has flexibility to engage with such partners in what way it sees fit, within constraints of safety and quality, and with due regard to Safeguarding. Support & Planning 4. The Service Provider will provide the Care & Support for Individuals placed at Eleanor Apartments, to be listed in agreement with The Commissioner, and to co-produce plans that will describe how the Individuals want to live their lives and the supports they will use to do the things cited in their plans, towards meeting the needs identified by the Delegated Microcommissioner and ensuring the tenant gets the outcome they require. 5. The Service Provider will assist people to produce plans that are relevant and meaningful to every Individual covered by this agreement. For some this will entail involving other people who are involved in the Individuals’ lives so that plans reflect personal needs, aspirations and interests and allow Individuals to access and contribute to community life. Plans will be reviewed in partnership with the Individual and adjusted as identified by the Individual in response to changes in need and goals. 6. The Service Provider will complete the planning process with all of the people identified on the agreed list within 3 months of agreement of placement. Care & Support will be available to the Individual as soon as they are tenanted within Eleanor Apartments. Funding& ISF duties 7. The funding for each Individual’s care package will be determined on an individual basis, dependent on assessment of needs and agreement of the outcomes with the Delegated Micro-commissioner. ISF AGREEMENT DRAFT ISF AGREEMENT DRAFT The Commissioner reserves the right to assess the needs of individuals covered under this agreement and propose revised budgets from time to time, through the delegated microcommissioner. The Service Provider, in agreement with the service user, will pool the resource and divide this money between the persons listed into distinct Individual Service Funds (ISFs). The method of calculating the division will be agreed with The Commissioner and the individual allocations will be approved by the delegated Micro-commissioner. It is expected that ISF allocations will meet people’s needs. The Service Provider must maintain records of how individual funds have been spent and of the levels of support provided by The Service Provider or other agencies. These records must also contain details of ‘banked’ funds that have put aside for future use. The records must be made available as a whole to The Commissioner when requested, and made available to the microcommissioner on an individual basis for occasions such as audit and review. In the event that The Service Provider cannot respond to the needs of an individual within existing allocations, they will request the delegated micro-commissioner to undertake a review of the individual’s case and the tenant can choose another provider to meet their needs. Where the individual is required to make contribution to their care package, as determined through the micro-commissioning assessment process, The Service Provider is required to put in place adequate process to gather that contribution and account for it through the Individual Service Fund records. The cost of managing the Individual Service Funds is encompassed within the Individual’s individual budget, as identified by delegated micro-commissioner. The Service Provider must keep a record of efficiencies and flexibilities achieved through the Individual Service Fund approach for annual report to The Commissioner. The Service Provider will provide appropriate advice and support to customers to enable them to safely administer and account for their ISFs. Customers will be free to choose to spend their ISF on supports other than those provided by The Service Provider and are free to leave The Service Provider services completely by withdrawing their ISF from this arrangement. In the event of a person leaving this arrangement they will require alternative placement, which the Service Provider will facilitate by notifying and co-operating with the delegated Micro-commissioner without bias or impediment. The Commissioner will make payments due under this arrangement for Individual Service Funds in 12 equal monthly payments. Payments will be made through Community Care Finance payment system. Changes and Termination of this agreement 18. This agreement can be changed if: a. The Service Provider can no longer support the individual for the agreed budget (seeking re-assessment) b. The Service Provider can now provide support at a lower cost than agreed (efficiency) c. The individual’s needs or circumstances change d. Subsequent Agreements are made and agreed, negating this Agreement. 19. This Agreement can be terminated with 3 months of notice if: a. The Commissioner believes individuals are unsafe or need different support arrangements c. Individuals no longer want support from the Service Provider d. The Service Provider is no longer willing to support the individuals e. There is mutual consent between the parties 20. The Commissioner reserves the right to terminate the agreement completely and immediately if it believes that there is immediate risk to the safety of the individuals.
