Holiday 2012 Publication of the Eighth District Dental Society of the State of New York 2013 Eighth District President’s Reception
Dr. John J. Nasca will be installed as 2013 President of the Eighth District Dental Society at The Buffalo Club on Saturday, January 26, 2013. The evening begins with cocktails and hors d’oeuvres at 6:00 pm, the program at 7:00 pm, with dinner and dancing to follow. Dr. Nasca received his DDS from SUNY at Buffalo School of Dental Medicine after obtaining his BS in Biology from Boston College. He has been a general dentist in private practice in Williamsville since 1989. Dr. Ronald H. Jarvis will be the recipient of the prestigious Dr. Harvey Sprowl Leadership Award. It is given to recognize the long term contributions of members of the Eighth District Dental Society to organized dentistry. Dr. Jarvis received his DDS from SUNY at Buffalo School of Dental Medicine and his MSD from Indiana University. He practices prosthodontics in Amherst. Life membership is bestowed on members attaining the age of 65 and who have been members in good standing for 30 consecutive years or 40 total years. From the Editor Branding for our Future By Chester J. Gary, DDS, JD In today’s competitive economy, marketing experts advise dentists to brand their practices to make them visible in a positive and distinctive manner. In order to compete, many dentists elect to promote themselves as providers of quick, easy and painless cosmetic fixes. Practices branded in this way can find success at some level, since it exploits our society’s obsession with personal appearance and immediate gratification. As one would expect, such success is short term and wanes with the current trend. Regretfully, when we market dentistry as an elective cosmetic commodity and, in some cases, allow patients to consume that commodity to their detriment, it violates our ethical commitment to provide competent and timely care. In the long term, this brand will threaten our very status as a profession. One problem with the quick cosmetic fix branding is that it is ultimately misleading. Dentists know the attainment of good oral health is not always quick, easy or pain free. Excellent esthetics, while an integral goal of all treatment, can only be competently achieved as part of a comprehensive treatment plan. This plan often involves significant patient investment of time, discipline and money. Isolated and fragmented fixes external to such a plan can harm the patient. smile makeovers before they attain their oral health. However, patients, unlike customers in business transactions, are not always right. This is especially true when our own branding has confused the patient regarding their expectations. Dentists who yield to the patient’s pressure and render such treatment for personal gain violate the central tenet of professional ethics; they choose their own financial self­interest over the best interests of the patient. Often, patients will claim that the principle of autonomy and their legal right to self­determination bestows upon them the privilege to do what they want with their bodies. However, a dentist’s ethical and legal duties to recognize this right is limited to provide care within the bounds of accepted treatment. If a given treatment could potentially injure the patient, then the practitioner, in order to avoid malpractice liability, must decline to render such care. The greater risk of branding dentistry as an elective quick fix is the loss of society’s trust in the dental profession. The public will ultimately discover this brand of dentistry is not consistent with their long­term oral health. Health insurers will decrease reimbursements due to lack of medical necessity, and regulators will begin to view dentists as undeserving of professional status. The brand for dentistry’s future must emphasize the relationship of the oral cavity and oral health to patients’ general health. Historically, dentistry has enjoyed an excellent reputation with the public. As a result of generations of dentists who have invested the time and effort to educate patients on the (Continued on page 9) From the President Final Thoughts

Dowd, DDS As I complete my year as the 2012 President of the Eighth District Dental Society, I would like to take the time to thank the entire membership for their immeasurable help in keeping our organization incredibly productive and effective. It has been a wonderful year for me and I have enjoyed every minute of it. It has also been very challenging and I hope the members of the Society have received the leadership they were looking for and deserved. The Eighth District Dental Society enjoyed many successes in the year 2012. The new Mentoring Program between the Society and the University at Buffalo School of Dental Medicine got off to a great start and will be a strong program for next year as well. An agreement between the Health Foundation of Western and Central New York and the Eighth District Dental Foundation culminated with the donation of $7,500 to the CARES Program at the University at Buffalo. It also produced a series of oral health presentations and oral cancer screenings at some of our local Senior Centers beginning in November of this year. The UB Dental School and the Eighth District set up a program in which private practitioners can refer implant patients to the school by choice in order to save costs and help the access to care issue in a small way. Our yearly events, including the Installation Dinner , the golf tournament and our multiple Mall Fairs during Children’s Dental Health Month in February, went off without a hitch due to great staff and membership collaboration. With all of these accomplishments we were also able to balance our budget and carry a $40,000 surplus into our next fiscal year. I would be remiss if I did not thank our outgoing Executive Director, Ms. Vicki Prager. She has given selflessly and fully to our organization and will leave it in much better shape than when she started. She supported and fostered a number of new member events, acquired grants when needed and helped set up a women dentist committee. She worked very hard and gave her best to the Society and will be missed. Her Office/Accounting (Continued on page 9)

Executive Director’s Note By Vicki J. Prager, JD It is with great sadness that I write my last Executive Director’s column for the Eighth District Bulletin. It has been my pleasure to work at the Eighth District Dental Society for the last four years; however, family obligations have necessitated my leaving. I have made many wonderful friends through my job. I especially appreciated the opportunity to have worked with all of the officers, the Executive Council and the Boards of the Eighth District Dental Society, the Eighth District Dental Foundation, the Eighth District Relief Corp., the Eighth District Service Corp. and the Erie County Dental Society. It was a joy to work with such intelligent and dedicated professionals. I will miss all of you. My successor is Mr. Chris Klimecko. He will officially begin his duties as Executive Director January 2, 2013 but will begin the transition into the job immediately. He is originally from the Western New York area and will be moving back from Lake Ariel, PA. Mr. Klimecko is finishing a two year term as a church minister in Lake Ariel and was also Executive Director of the Red Bird Mission prior to that in Kentucky. As you know, many dentists were affected by Hurricane Sandy. Dentists are able to apply for grants through NYSDA and the ADA for immediate personal needs up to $1,000 and for larger Disaster Assistance Grants which provide up to $5,000 for property damage. If you would like to make a donation to help provide assistance to dentists, you may send it to the Eighth District Dental Foundation and all funds collected will be forwarded on your behalf. The ADA will be hosting a conference in Chicago on April 25­27, 2013 for evidence based dentistry. Attendees will learn how to apply evidence based dentistry principles and tools in clinical decision making. If you are interested in attending, please contact the ADA. You will earn up to 14 hours of CE. Registration is $150 and does not include hotel and travel. On Nov. 26, the U.S. Department of Health and Human Services offered guidance on de­identification of protected health information for HIPAA covered entities. Focus on Ethics: Top Dentist & Buffalo Spree Q: I have seen advertisements whereby a dentist claims to be a “Top Dentist.” I have also seen advertisements in the December/2011 and the December/2012 issues of the Buffalo Spree magazine whereby General Dentists and a commercial Dental Laboratory have been included in the Special Advertising Section listed as Dental Specialties. Are these claims ethical? Is this type of advertising acceptable given our Code of Ethics? A: Under the Code of Ethics, as it relates to advertising, one cannot utilize terms that claim superiority or that may possibly mislead patients. The test for this is what a reasonably prudent patient would be likely to believe from seeing an advertisement, not what the most foolish person might be misled by or what the wisest person would know not to be deceived by. However, there is a presumption that patients possess reasonable discernment and ordinary intelligence. Often, patients read advertisements and view the Top Physician and Dentist magazines to see if their provider is on the list. These lists basically result from colleagues voting for other colleagues. This could be viewed as a popularity contest. Since we are unable to prove that one dentist is better than another, such ads are misleading to patients, but rarely is the dentist the person paying for the ad in such lists. The New York State Office of Professional Discipline (OPD) will not take action against such lists and only if the dentist is paying to be

listed as a “top dentist” is such a list attributable to the dentist as an advertisement. Even then, OPD takes the position that the public has the ordinary discernment to make of such lists what they will and will not find them inherently misleading. Ethics takes the position that when such lists are used by a dentist to further solicit patients on the basis that the “top dentist” claim is a genuine mark of clinical superiority, then it becomes an ethical violation to use such a list or designation in such a way because it ignores the fact that there really is no scientific or meaningful evaluation of clinical skill in such a claim. The NYSDA Ethics Council has addressed the issue of “Top Dentist” in the past. Since “Top Dentist” is not scientifically based and implies superiority, it was concluded by the Council that it is unethical to use the term in any type of advertisement, including website advertisements. It was decided that a plaque can be displayed in a dental office ­­­ yet, this claim cannot be made in an advertisement that attempts to trade on or promote the person clinically as a genuine “top” dentist. The special areas of dental practice approved by the American Dental Association and the designation for ethical specialty announcement and limitation of practice (Continued on page 17) March 1, 2013 Spring All Day Seminar Friday, March 1, 2013 will serve as the Eighth District Dental Foundation’s 2013 Spring All Day Seminar. The speaker for this event will be Dr. Dean Morton, Professor and Chairman of the Department of Oral Health and Rehabilitation at the University of Louisville, School of Dentistry. Dr. Morton’s presentation ­ “Planning & Treating Patients with Implant Needs: Enhancing Outcomes Through Evolution in Techniques & Materials” will focus on diagnosis and principles as they relate to the contemporary practice of implant dentistry. The 2013 Spring All Day Seminar will be held at Salvatore’s Italian Gardens in Depew. The day will begin at 8am with registration & breakfast, and will continue until 4pm with a break at 12pm for lunch and the Eighth District Business meeting. The course will offer 7MCE credits to attendees. The cost to attend is $175 for Eighth District member dentists and $225 for dentists who are not members of the Eighth District. Ivoclar Vivadent is graciously sponsoring the cocktail hour to immediately follow the seminar. 2013 Dental Fairs Needs Volunteers
The Eighth District Dental Foundation is looking for volunteer dental professionals to assist in staffing the Dental Fairs sponsored by the Foundation during Children’s Dental Health Month in February. According to Dr. Darren Forcier, Chair of the Eighth District Children’s Dental Health Month Committee, assistance is needed for brochure and dental product distribution, answering frequently asked questions, and organizing children’s dental health related entertainment. These are fun events with surprise appearances from Dudley the Dinosaur. You can volunteer for as little as on hour at one location or all day at all locations. The Foundation will be at the Boulevard Mall in Amherst on February 2nd from 10am to 2pm and at the Fashion Outlets in Niagara Falls on February 9th from 10am to 2pm. Dentists and their staff are encouraged to participate in these events. Any assistance you can provide would be greatly appreciated. November 7, 2012 Valley Community Senior Center Oral Cancer Screening The Eighth District Dental Foundation recently received a grant from the Health Foundation of Western & Central New York to support strategies directed at improving the oral health care of seniors in the community. A portion of this grant is to fund oral cancer screenings at community Senior Centers. The first screening took place on November 7, 2012 at Valley Community Association in Buffalo, NY. Approximately 40 seniors participated in the program. The Eighth District Dental Foundation provided all participants with an oral cancer screening, free dental products, and lunch. December 5, 2012 Clarence Senior Center Oral Cancer Screening The second screening took place on December 5, 2012 at Clarence Senior Center in Clarence, NY. A pprox imately 30 seni ors participated in the program. New Name, Same People Submitted By: Robert E. Sauda CPCU Since 1974, the name “Jacob Hauck Agency” has been known as the insurance agency of choice for members of Eighth District. In 2002, Jacob Hauck Agency merged with Walsh Duffield, who also used the name Walsh Insurance Group. Because of the familiarity with the Jacob Hauck name, we decided to continue its use as a member company of the Walsh Insurance Group. It has been ten years since we became part of Walsh Duffield and have decided the time is right to drop the Jacob Hauck Agency name. Beginning January 2013, we will be known by our formal corporate name ­ Walsh Duffield Companies, Inc. The Walsh name should be familiar to members of Eighth District, as the name has appeared in print and on our letterhead and envelopes for a number of years. The name change will allow us to have a standardized look throughout our organization and avoid confusion for our policyholders and our staff. The important point to remember is that there will be no change in personnel. The same individuals who have counseled you on your insurance coverage will still be available to answer your calls and service your needs. Along with our new name, we will market our insurance products and services under the name and logo of “The Dental Insurance Center @ Walsh Duffield.”

are: dental public health, endodontics, oral and maxillofacial surgery, oral and maxillofacial pathology, oral and maxillofacial radiology, orthodontics and dentofacial orthopedics, pediatric dentistry, periodontics, and prosthodontics. A dentist who indicates that he/she specializes in any field not recognized as a specialty by the American Dental Association and the Board of Regents of the State of New York is engaged in unethical conduct. Listing coursework and special training is acceptable and encouraged, as long as it is not misconstrued as unearned specialty qualifications or an unverifiable claim of superiority. Such areas as sedation dentistry, sleep apnea and implantology are not recognized dental specialties. A dentist is responsible for his/her own advertising. It is not a web­designer’s responsibility to review the content of what you are displaying in a website advertisement. The dentist must review all that is contained in such an advertisement and sign off/accept the design and content before this can be listed on the web. The same would be true of advertisements that appear in magazines such as the Buffalo Spree. If the Special Advertising Section is marketed under the heading of Dental Specialties, then (even if the publication staff is not aware of the ethical rules, regulations, and guidelines which govern our profession) general dentists should not be included in this section on advertising. Dental laboratories are not subject to the ethical rules of the local component, NYSDA, or ADA, and while they are governed by the general laws prohibiting false advertising by commercial businesses, they do not have to adhere to the more stringent ethical rules set by dental associations or even the professional conduct rules of OPD. False commercial advertising complaints against dental laboratories are handled by the New York State Attorney General, where they are likely to be given a low priority in the absence of demonstrable potential for widespread or serious public harm. Prior to placing an advertisement in a publication, ask if there is going to be any special designation that will be assigned to this section. If your practice does not fall within the umbrella/heading that will be assigned, then your practice should not appear in such an advertisement. Know the content and review the content in its entirety. Be certain that what information you are portraying about yourself and your practice is allowable under the Code of Ethics of the New York State Dental Association and the American Dental Association. 2013 ECDS Installation Dinner
Dr. Peter Rouff will be installed as 2013 President of the Erie County Dental Society at the Greatbatch Pavillion of the Martin House Complex on Saturday, January 5, 2013. The event begins with cocktails and hors d’oeuvres at 6:30 pm, the program at 7:30 pm, with dinner and dancing to the music of Central Groove to follow. Dr. Marshall Fagin will be the recipient of the prestigious Frank Stone Award. The Frank Stone Award is given to an individual who in the considered judgment of its Erie County Dental Society members, 1) has made outstanding contributions to the dental profession in Erie County through teaching, patient service, dental research, organized dentistry or community service; 2) must be a role model for the dental profession who inspires his/her colleagues and mentors younger dentists to become all that they are capable of being; 3) demonstrates a high level of involvement in the dental profession and organized dentistry as well as the community in which he/she contributes their profession; 4) is an effective communicator for the profession and represents the highest personal standards of integrity, compassion and moral character. Life membership is bestowed on members attaining the age of 65 and who have been members in good standing for 30 consecutive years. These are the members who will receive the honor this year: John P.
