MISSION STATMENT
The Monroe County OWI Treatment
Court mission is to enhance public health
and safety and improve the quality of life
for all residents, by providing intensive
monitoring, individualized treatment and
comprehensive services. OWI Treatment
Court will enable participants to break the
cycle of addiction.

 Monroe County Resident
 18 years of age or older
 Convicted of one of the following
repeat OWIs: 3rd felony, 4th , 5th or
6th OWI offense
 Agree to abide by Program rules
 Meet diagnostic criteria for
substance dependency
 Supervised by WI Department of
Corrections

TREATMENT COURT GOALS
 Decrease number of OWI Offenses
 Decrease number of other
substance related crimes
 Promote public safety by reducing
recidivism rates of substancerelated offenses
 Hold offenders accountable by
offering effective sanctions,
rewards, and treatment
 Introduce offenders to an ongoing
process of recovery designed to
achieve total abstinence from
alcohol & other illicit/illegal drugs
 Promote self-sufficiency and
empower chemically dependent
individuals to become productive
and responsible members of the
community
KEY COMPONENTS OF AN OWI
TREATMENT COURT PROGRAM
1. Integrate alcohol and other drug
treatment services with justice system
case processing.
2. Using a non-adversarial approach,
prosecution and defense counsel
promote public safety while
protecting participants’ due process
rights.
3. Eligible participants are identified and
placed in the program as soon as
possible.
4. Provide access to a continuum of
alcohol, drug, and other related
treatment and rehabilitation services.
5. Abstinence is monitored by frequent
alcohol and other drug testing.
6. A coordinated strategy governs
responses to participant’s compliance.
7. Ongoing judicial interaction with each
participant is essential.
8. Monitoring and evaluation measure
the achievement of program goals and
gauge effectiveness.
9. Continuing interdisciplinary education
promotes effective OWI Court Team
planning, implementation, and
operations.
10. Forging partnerships among
Courts, public agencies and
community-based organizations
generates local support and
increases effectiveness
THREE PHASES OF OWI COURT:
PHASE I
* Minimum 180 days (6 months)
* Complete all required assessments
(including AODA / OWI Assessment and
Driver Safety Plan)
* Comply with all testing required by
treatment team
* Court appearance bi-weekly
* 5 support group meetings per week
* Comply with Probation rules
* Meet with case manager as directed
* Complete Victim Impact Program
* Comply with curfew
* Pay all required fees/costs
* Pay $50/month or $300 by end of Phase
* Minimum 90 days consecutive and
absolute sobriety
* Comply with all OWI Court Team
directives and/or modifications.
PHASE II
* Minimum 180 days (6 months)
* Complete all required assessments
* Comply with individualized treatment
* Comply with all testing
* Court appearance monthly
* 3 support group meetings per week
* Comply with Probation rules
* Meet with case manager as directed
* Full-time employment / school
* Pay all required fees/costs
* Pay $50/month or $300 by end of Phase
* Minimum 120 days consecutive and
absolute sobriety
* Comply with all OWI Court Team
directives and/or modifications.
PHASE III
* Minimum 180 days (6 months)
* Complete all required assessments
* Comply with individualized treatment
* Comply with all testing required
* Court appearance monthly
* 2 support group meetings per week
* Comply with Probation rules
* Meet with case manager as directed
* Full-time employment / school
* Pay all required fees / costs
* Pay remaining $350 by end of Phase
* Complete closing presentation
* Minimum 120 days consecutive and
absolute sobriety
* Comply with all OWI Court Team
directives and/or modifications.
BACKGROUND HISTORY
The Monroe County OWI Treatment
Court is a court that is specifically
designated and staffed to handle cases
involving operating while intoxicated
repeat offenders through an intensive,
judicially monitored program of chemical
dependency treatment, rehabilitation
services, and strict community
supervision. The concept is based on an
innovative program that was first
developed in Miami, Florida in 1989. The
OWI Treatment Court concept has since
received widespread attention as an
effective treatment strategy for chemically
dependent criminal offenders. There are
more than 1,000 such specialty programs
now in operation in jurisdictions
throughout the nation.
