STM COMMERCIAL TEXT AND DATA MINING TRANSLATION RE-­‐USE LICENCE D (with certain Reserved Commercial Rights) STM LICENCE FOR COMMERCIAL RE-­‐USE RIGHTS OTHER THAN RESERVED COMMERCIAL RIGHTS (INCLUDES RIGHTS FOR TRANSLATION AND TEXT AND DATA MINING (“STM COM/NONCOM SL”) v. 1.0 Agreeing to the Publisher’s licence enables the Licensee (“Researcher”) and any downstream user to: Use the Work/Article anywhere in the world for non-­‐commercial purposes, including by access, download, copy, display in any manner or form, redistribute, translate and transcribe in any language, “text and data mine” (see definition), abridge, describe the Work/Article provided that Licensee/users: •Cite the Work/Article using an appropriate bibliographic citation, eg authors, book/journal, article title/chapter title, volume, issue, page numbers, DOI and the link to the definitive published version. •Use the article for non-­‐ commercial purposes and for commercial uses other than certain “Reserved Commercial Rights” set out below. •Maintain the integrity of the Work/Article. •Retain copyright notices and links to these terms and conditions so it is clear to other users what can and cannot be done with the Work/Article. •Ensure that, for any content in the Work/Article that is identified as belonging to a third party, any re-­‐use complies with the copyright policies of that third party. Commercial uses are granted upfront as part of this licence by the Publisher to you, the Licensee, unless they are “Reserved Commercial Rights” (RCR). RCR are defined below and are specifically excluded from this Licence and not granted to the Licensee upfront, but may be available on request from the Publisher, case by case, by way of a separate written agreement. RCR are uses of the Work for the purposes or in the way described below: -­‐ the sale of reprints or copies in any manner or form. -­‐ The provision of reprints or copies in the course of selling educational or information services of the user. -­‐ the distribution of reprints for advertising or marketing of the user’s products or services or corporate identity -­‐ the provision of sponsored access to licensed materials to customers or end-­‐users of the products or services offered by the user. -­‐ The sale or distribution of any translation of the Work for money or money’s worth or for advertising, marketing or promotion of company products or services. • “text and data minig” as used herein means loading and technically format the Work/Licensed Material on the Licensee’s server using automated programs or devices to download, index extract semantic entities, derive patterns and for the Licensee to evaluate and interpret any TDM Output (“TDM Output” means the result of any Text and Data Mining activity or operation, capable of fixation, reproduction and/or communication in any form) for access and use by Licensee, but without creating Adapted Material, product or service that competes with the Work/Licensed Material.
