File: 508.03R1 Page 1 of 2 COMMUNICABLE DISEASES PROCEDURE Exclusion The building principal, or the principal's designee shall exclude any student who, based upon a clear factual situation, is believed to have a dangerous communicable disease. Before such suspension shall take effect, the student shall be given oral or written notice of the factual situation relied upon and shall have an opportunity to present further factual circumstances. Within twenty-four (24) hours, or such additional time as is reasonably necessary following the exclusion, the principal or the principal's designee shall send a written statement to the student, the student's parents, or guardian describing the factual situation and the reasons for the action taken. The principal or the principal's designee shall make a reasonable effort to hold a conference with the parents before or at the time the student returns to school. If the exclusion is to extend beyond five (5) school days, in addition to the foregoing, the procedure described for long term suspension as provided in state statutes shall be incorporated herein and followed. Readmission: As to all cases where a student is excluded as a result of a dangerous communicable disease, except as provided in the next paragraphs, the student excluded shall be readmitted upon the school nurse's approval, or a note from the student's physician indicating the student is no longer contagious; provided, that the superintendent may require examination by the board physician before readmission. As to any student who is diagnosed to have an active chronic communicable disease (defined below), the student shall be readmitted after the development of an appropriate education plan (AEP). The AEP shall be developed by the administration and will consider the following individual factors: 1. The nature of the risk (how the disease is transmitted). 2. The duration of the risk (how long the carrier is infectious). 3. The severity of the risk (what is the potential harm to third parties). 4. The probabilities the disease will be transmitted and will cause varying degrees of harm. 5. Behavior of the student. 6. Neurological development. 7. Physical condition. 8. Open sores that cannot be covered. 9. Toilet training. 10. Educational/cognitive development. 11. The risk to the infected student. In all circumstances, the AEP shall, if possible be based on reasonable accommodations, place all students who are otherwise qualified in the placement they would normally receive were they not infected. The AEP shall also state which members of the faculty and staff will be informed of the student's condition. This information will only be divulged to individuals if said individual has a recognizable need to know. File: 508.03R1 Page 2 of 2 The student, parents or student's guardian shall be given a written copy of the AEP and shall have five (5) school days after receipt to request a conference with the administrators regarding the AEP, which conference shall be held within five (5) school days of the request. If an agreement is not reached at said conference, the student, parents or student's guardian shall have five (5) school days to request a hearing before the Board. The hearing before the Board will be had within seven (7) days of the request. The administration shall review the AEP monthly and, if necessary, amend the AEP. Upon any such amendment the student, parents or student's guardian shall be entitled to the same conference and appeal rights as upon the original AEP. Active chronic communicable diseases shall include: 1. Diseases related to the Human Immunodeficiency Virus (HIV), including Acquired Immune Deficiency Syndrome (AIDS) and Aids Related Complex (ARC). 2. Cytomegalovirus (CMV). 3. Herpes Simplex Virus (HSV). Confidentiality: All medical records of students shall be treated as confidential. The contents shall not be divulged to any individual, except in the case of a student with an active chronic communicable disease the nature of the disease shall be disclosed to all staff members to include nurses and secretarial employees if appropriate as determined by the AEP responsible for supervision of the student.
