Annex: Terms and Conditions governing the access to the data of the marine analysis and
forecasting system of the National Group of Operational Oceanography - INGV

According to D. lgs. of 30 June 2003 No. 196, INGV shall keep reserved the information
received by users. All information will be handled only to the purpose of the use of the
file server INGV, according to the legal provision in force.

Terms and Conditions for Access to Data
for non commercial users
These Terms and Conditions are applicable to public and private non commercial users of
the data of the marine analysis and forecasting system of the National Group of
Operational Oceanography (GNOO)- INGV.
Users of the system agree that :
To apply for access to the data of the GNOO analysis and forecasting system users must
submit the Data Access Request Form, where purposes of the use of the requested data
must be specified.
Users may download data only for non-commercial use connected with their work as
employee of their organization of belonging. They shall keep secret to third parties the
password received by INGV. They shall not transfer data and products to third parties.
They may not copy, reproduce, transmit or distribute the data downloaded. Neither
these materials nor any portion thereof may be stored in a computer except for noncommercial use. Users may not use the content in any way not specifically declared in
the Data Access Request Form without the specific consent of INGV.
They will use the material only for lawful purposes.
ACKNOWLEDGEMENT
Users shall indicate the source of INGV data in any publication arising out of the use of
data and products obtained by the operational system of GNOO.

DISCLAIMER
The data and products of the GNOO operational system are provided “as is” and without
warranties of any kind, whether express or implied.
INGV does not make any warranties regarding the accuracy, completeness, correctness,
adequacy, timeliness, reliability of the data released by the system.
INGV will not be held liable for any delays, inaccuracies, errors, or omissions therefrom,
or in the transmission or delivery of all or any part thereof or for any damages arising
from the use of the data. Users waive any claim against INGV in relation to interpretation
of the data.
LIABILITY
Users are held responsible of any access to the data made through the password that
they have been assigned. They are responsible for any damage caused to INGV due to
misuse of the password done by themselves or by third parties.
Users shall indemnify INGV for any damages it may incurr as a result of a breach of the
terms herein or in connection with their use of the data. INGV reserves the right to
demand that users destroy data they have received.
MODIFICATIONS
These terms and conditions, or any of them, may be modified or terminated by INGV
without notice at any time for any reason. Any change will be published on the web sites
http://gnoo.bo.ingv.it/mfs and http://gnoo.bo.ingv.it/afs. INGV retains the right to
deny access to the users and to anyone accessing the data under their registration. INGV
may deny access to anyone who violates any part of the Terms and Conditions.
APPLICABLE LAW
The agreement between the INGV and the users shall be governed by the laws of Italy.
