SAVBAT2 TERMS AND CONDITIONS

Acknowledgement of reading
The Department requires you to read, accept and abide by these Terms and Conditions when using
the Version 2 of the Savanna Burning Abatement Tool (SavBAT2). By accessing the SavBAT2 you
also agree to be bound by these Terms and Conditions.

Definitions

“Department” means the Commonwealth of Australia, as represented by the Department of
the Environment or any other Commonwealth agency or body responsible for the
administration of the SavBAT2 from time to time.

“SavBAT2” means the Savanna Burning Abatement Tool (SavBAT2). The SavBAT2
automates GIS and spreadsheet operations required to estimate greenhouse gas emissions
for a project or potential project in accordance with the exposure draft of the Carbon Credits
(Carbon Farming Initiative—Emissions Abatement through Savanna Fire Management)
Methodology Determination 2015.

“Terms and Conditions” means these Terms and Conditions of Use.
Changes
The Department may make changes, improvements and/or modifications to the SavBAT2 at any time
without notice.
The Department may make changes to these Terms and Conditions at any time without notice.
Subsequent use of the SavBAT2 constitutes acceptance of such changes.

Accuracy
The Department does not guarantee the completeness or accuracy of the material provided on the
SavBAT2. The Department suggests you seek your own professional, independent advice about the
SavBAT2 and any of your entitlements or obligations that relate to the exposure draft of the Carbon
Credits (Carbon Farming Initiative— Emissions Abatement through Savanna Fire Management)
Methodology Determination 2015 and the Carbon Farming Initiative Act 2011.

Liability
In no event shall the Department, its employees, officers, sub-contractors or third parties be liable to
you for any damages, including without limitation, direct, indirect or consequential damages (including
without limitation, damages for loss of profits, business interruption, or loss of information) arising out
of the use, inability to use, or the results of use of the SavBAT2, any sites linked to the SavBAT2, or
the materials or recommendations or information contained at any or all such sites whether based on

warranty, contract or tort (including negligence) and whether or not advised of the possibility of such
damages. The Department is not liable for matters arising as a direct result of inaccurate information
that you have provided.
6.
Responsibility for actions
You are responsible for (and you indemnify the Department against) any loss or damage to any
person arising from any one of the following:

any breach by you of these Terms and Conditions; and

any wilful, negligent or unlawful act or omission by you in relation to, or in the course of using,
the SavBAT2.
Your responsibility for activities undertaken by you through the SavBAT2 will continue despite ceasing
to use the SavBAT2 or having access to it.
You must not use the SavBAT2, or information obtained through the SavBAT2 for any unlawful
purpose.
If you obtain from the SavBAT2 fire scar data (or any information or output which contains fire scar
data) from the years 1988-2000 you must ensure when using the fire scar data (or any information or
output which contains the fire scar data) that the following attribution is displayed: All fire scar data
from the years 1988 – 2000 is copyright Western Australian Land Information Authority (Landgate)
(YYYY). Contact Landgate to obtain approval if you wish to use the fire scar data for any purpose not
connected with a Commonwealth greenhouse gas emissions abatement programme.
7.
Security
Where appropriate, the Department uses available technology to protect the security of
communications made through the SavBAT2. However, the Department does not accept liability for
the security, authenticity, integrity or confidentiality of any transactions and other communications
made through the SavBAT2. Internet communications may be susceptible to interference or
interception by third parties. Despite its best efforts, the Department makes no warranties that the
SavBAT2 is free of infection by computer viruses or other unauthorised software. The Department will
not be liable for any loss, damage, cost or expense resulting from any breach of a security measure
(including viruses or other unauthorised software).

Linked Sites
The SavBAT2 may not contain all the information that you need. The Department is not responsible or
liable for the availability or content of any other internet site (not provided by the Department). Access
to any other internet site is at your own risk. If you create a link to the SavBAT2, you do so at your
own risk.
The Department reserves the right to object to any linking that infringes its rights. The Department has
not agreed to any conduct connected with a linked site which may be unlawful or an infringement of
rights.

9.
Applicable Laws
Use of the SavBAT2 and these Terms and Conditions are governed by the laws of the Australian
Capital Territory (ACT), Australia. Any claim relating to use of the SavBAT2 shall be heard by ACT
Courts. If you choose to access this site from a location outside Australia, you do so on your own
initiative and are responsible for compliance with applicable local laws.
10.
Privacy
All access to the SavBAT2 is anonymous via standard (non-encrypted) HTTP. The hosting server
may be used for temporary storage of user created records for the purpose of efficient and effective
delivery of the tool. The data will not be stored longer than required to perform the functions of the
tool and will not be available to anyone other than the user. The system does not record or report
individual user details. If user records are temporarily stored on the hosting server all data will be lost
should connectivity be lost.
The SavBAT2 contains links to other Web sites. Where the linked Web site is not administered by the
Department, the Department is not responsible for the privacy practices or the content of such Web
sites.
