Royal Canadian Mounted Police 20.1. Maternity Leave Without Pay 1. A member who becomes pregnant will inform her supervisor in writing of her plans for taking maternity leave without pay at least four weeks in advance of the initial date which the end of pregnancy is expected to occur. 2. She will be granted maternity leave without pay for a period beginning before, on or after the end date of pregnancy and ending no later than 18 weeks after the end date of pregnancy. 3. The member's supervisor may require a medical certificate certifying pregnancy. 4. Where the member's newborn child is hospitalized and the member has returned to work, the period of maternity leave may be extended by a period equal to that portion of the period of the child's hospitalization. The extension will end not later than 52 weeks after the birth of the child. 5. Before starting maternity leave without pay, the member may use her earned annual leave or LTO credits, or sick leave as outlined in ch. 19.3. Sick leave includes medical disability due to pregnancy. 6. For pregnant members on operational duties, see CMM 3.C.1.h. (C.1.h. A pregnant member will be assigned to administrative duties if she has requested such a reassignment, or it is recommended by a medical practitioner.) 7. The period of maternity leave without pay will be counted for the calculation of severance pay, annual leave and pay increments. 8. For maternity allowance, see ch. 21.1. Parental Leave Without Pay 1. Where a parent has or will have the actual care and custody of a newborn child, the member will, upon request, be granted parental leave without pay to a maximum of 37 weeks in a 52-week period. The parental leave may be taken all at once or in two periods from the date of birth of the child. 2. Where a member has started legal proceedings under the laws of a province/territory to adopt a child, the member will, upon request, be granted parental leave without pay to a maximum of 37 weeks in a 52-week period. The parental leave may be taken all at once or in two periods. The leave may begin no sooner than two weeks before the week the child comes into the care of the parent for the adoption. 3. A member who intends to request parental leave without pay will notify his/her supervisor at least four weeks in advance of the start date of the leave. 3. 1. The supervisor may request proof of a legal adoption or birth of a child. 4. A married or common-law couple appointed under the RCMP Act, who request parental leave without pay to care for the same child must notify their supervisors at least eight weeks in advance of the date the absence will start. 5. Where the newborn or adopted child is hospitalized and the member has returned to work, the period of parental leave (37 weeks maximum) may be extended by a period equal to that period of the child's hospitalization. This extension will end not later than 104 weeks from the date the child comes into the member's care. 6. Maternity Allowance 21-1-1 Maternity Allowance Agreement 1. A member on approved maternity leave without pay will be paid a maternity allowance in accordance with the Supplemental Unemployment Benefit (SUB) Plan when she: 1. 1. has completed six months of continuous employment in the RCMP; 1. 2. provides her supervisor with proof that she has applied for or is in receipt of maternity benefits under the Employment Insurance (EI) or Québec Parental Insurance Plan (QPIP); and 1. 3. signs the maternity allowance agreement outlined in App. 21-1-1. (Provided below) 2. The maternity allowance agreement states she will: 2. 1. return to work at the end of her maternity leave, 2. 2. work for a period equal to the period covered by the allowance, and 2. 3. be indebted to the RCMP for all or part of the amount received if the member fails to meet the conditions in the maternity allowance agreement for reasons other than death, lay-off or having become disabled as defined in the RCMP Superannuation Act. EXCEPTION: A temporary civilian employee whose specified period of employment expired and who is re-hired in any portion of the Public Service of Canada as specified in Schedule I and IV, Financial Administration Act within 90 days or less will not be indebted to the RCMP if his/her new period of employment is sufficient to meet the employment obligation specified in the maternity agreement. 3. Maternity allowance payments made in accordance with the SUB Plan consist of the following: 3. 1. where the member is subject to a two-week waiting period before receiving EI benefits, will receive 93% of the weekly rate of pay for each week of the waiting period, less any other monies earned during this period; and 3. 2. for each week the member receives a maternity benefit under EI or QPIP, will receive the difference between 93% of the weekly rate of pay and the benefit paid under EI or QPIP, less any other monies earned during this period. 4. The maternity allowance for the first six weeks of maternity leave will be estimated and automatically advanced to the member unless the member advises otherwise. 5. The weekly rate of pay for calculating the maternity allowance is the member's substantive pay, and if applicable, the terminable or transitional allowance, or the acting premium pay when the member has been in receipt of acting premium pay for four months or more. 6. Where the member has been working part-time or combined full-time and part-time immediately before the start of maternity leave, the weekly rate of pay will be the average salary on the preceding 26 weeks. 7. Where the member becomes eligible for a pay increment or pay revision while in receipt of the maternity allowance, the allowance will be adjusted accordingly. 8. The maximum combined maternity and parental allowances payable to a married or common-law couple who are appointed under the RCMP Act, will not exceed 52 weeks for each combined maternity and parental leave without pay. --------------------------------------------------------------------------------------21.2. Parental Allowance 21-2-1 Parental Allowance Agreement 1. A member on approved parental leave without pay will be paid a parental allowance to a maximum of 37 weeks in accordance with the Supplemental Unemployment Benefit (SUB) Plan when the member: 1. 1. has completed six months of continuous employment in the RCMP; 1. 2. provides his/her supervisor with proof that he/she has applied for or is in receipt of parental benefits under the Employment Insurance (EI) or parental, adoption or paternity benefits under the Quebec Parental Insurance Plan (QPIP); and 1. 3. signs the parental allowance agreement outlined in App. 21-2-1. The parental allowance for the first six weeks of parental leave will be estimated and automatically advanced to the member unless the member advises otherwise. 6. The weekly rate of pay for calculating the parental allowance is the member's substantive pay, and if applicable, the terminable or transitional allowance, or the acting premium pay when the member has been in receipt of acting premium pay for four months or more. 7. Where the member has been working part-time or combined full-time and part-time immediately before the start of parental leave, the weekly rate of pay will be the average salary on the preceding 26 weeks. 8. Where the member becomes eligible for a pay increment or pay revision while in receipt of the parental allowance, the allowance will be adjusted accordingly. 9. The maximum combined maternity and parental allowances payable to a married or common-law couple who are appointed under the RCMP Act, will not exceed 52 weeks for each combined maternity and parental leave without pay. -------------------------------------------------------------------------------------Appendix 21-1-1- Maternity Allowance Agreement 1. This agreement is between and the Commissioner of the Royal Canadian Mounted Police, the Employer for the purpose of receiving the maternity allowance. 2. I undertake to return to work for the RCMP on , or such later date as may be approved by my supervisor, and remain in the RCMP's employ and to work for a period equal to the period for which I received maternity allowance. 3. I understand that if I fail to return to work for the period covered by the allowance paid to me for reasons other than death, lay-off or having become disabled as defined in the RCMP Superannuation Act, I will be indebted to the RCMP for the allowance received, but not worked. EXCEPTION: A temporary civilian employee whose specified period of employment expired and who is re-hired in any portion of the Public Service of Canada as specified in Schedule I and IV, Financial Administration Act within 90 days or less will not be indebted to the RCMP if her new period of employment is sufficient to meet the employment obligation specified in the maternity agreement.
