Amendment to Regulation No 74 of the Minister for
Economic Affairs and Infrastructure of 22 September
2014 ‘Requirements for road construction materials and
the procedure for verifying the compliance thereof’, and
Regulation No 101 of 3 August 2015 ‘Road and road
works quality requirements’.
This Regulation is adopted on the basis of § 5(4) of the Product Compliance Act, § 1(1)(3)
and (2) of Government of the Republic Regulation No 123 of 26 August 2010 entitled
‘Granting of powers to establish a procedure for product requirements and compliance
assessment and the appointment of a market surveillance authority’, and § 96(3) of the
Building Code.
§ 1. The following amendments are made to Minister for Economic Affairs and Infrastructure
Regulation No 74 of 22 September 2014 ‘Requirements for road construction materials and
the procedure for verifying the compliance thereof’:
1) Section 4 is supplemented with Subsection 11 worded as follows:
‘(11) Certification of the compliance of the filling materials of a track bed shall be carried out
in accordance with assessment system 4.’;
2) The Regulation is supplemented with §§ 121 and 122 worded as follows:
Ԥ 121. Barriers to traffic noise
(1) Certification of the compliance of barriers to traffic noise shall be carried out in
accordance with assessment system 3.
(2) The basic properties of barriers to traffic noise according to their area of use shall be
determined and declared according to Clause 10 of the Annex to the Regulation.
§ 122. Material to stabilise road substrates
(1) Certification of compliance of the material to stabilise road substrates (hereinafter
‘stabiliser-binder’) shall be carried out in accordance with assessment system 2+.

(2) The basic properties of the stabiliser-binder according to its area of use shall be
determined and declared according to Clause 11 of the Annex to the Regulation.’;
3) The introductory sentence of Clause 1.1 of the Annex to the Regulation ‘Basic properties of
road construction materials and the methodology to determine them’ is amended and worded
as follows:
‘1.1. Coarse filling material and unfractionated filling material used in unbound and
hydraulically bound layers of the overburden (a product according to EVS-EN 13242 or
13285):’;
4) Annex to the Regulation ‘Basic properties of road construction materials and the
methodology to determine them’ is supplemented with Clause 1.1.10 worded as follows:
‘1.1.10. the quality of fines on the filling material unfractionated with sedimentary rocks and
materials containing sedimentary rocks (if the content of fines is f > 3) – test method EVSEN 933-9.’;
5) The introductory sentence of Clause 1.3 of the Annex to the Regulation ‘Basic properties of
road construction materials and the methodology to determine them’ is amended and worded
as follows:
‘1.3. Filling material in the drainage layer and excavated landfill when used up to a depth of
2 metres from the surface of the pavement (a product according to EVS-EN 13285 or
13242):’;
6) Annex to the Regulation ‘Basic properties of road construction materials and the
methodology to determine them’ is supplemented with Clause 1.5.11 worded as follows:
‘1.5.11. mineralogical composition of natural filling materials – test method EVS-EN 9323.”’;
7) Annex to the Regulation ‘Basic properties of road construction materials and the
methodology to determine them’ is supplemented with Clause 1.6.12 worded as follows:
‘1.6.12. mineralogical composition of natural filling materials – test method EVS-EN 932-3’;
8) Annex to the Regulation ‘Basic properties of road construction materials and the
methodology to determine them’ is supplemented with Clause 1.7.5 worded as follows:
‘1.7.5. mineralogical composition of natural filling materials – test method EVS-EN 932-3’;
9) Annex to the Regulation ‘Basic properties of road construction materials and the
methodology to determine them’ is supplemented with Clause 1.8.5 worded as follows:
‘1.8.5. CaCO3 content – test method EVS-EN 196-2;’;
10) Annex to the Regulation ‘Basic properties of road construction materials and the
methodology to determine them’ is supplemented with Clauses 1.9–1.10.4 worded as follows:
‘1.9. Coarse filling material and unfractionated filling material used in a road bed (a product
according to EVS-EN 13242 or 13285):
1.9.1. gradation – test method EVS-EN 933-1;

1.9.2. content of fines – test method EVS-EN 933-1;
1.9.3. water absorbency – test method EVS-EN 1097-6;
1.9.4. cold weather performance (if the water absorbency of the filling material is WA24
> 1) – test method EVS-EN 1367-1;
1.9.5. radioactive emission – in line with the principles of EVS 901-1.
1.10. Fine filling material used in a road bed (a product according to EVS-EN 13242 or
13285):
1.10.1. gradation – test method EVS-EN 933-1;
1.10.2. content of fines – test method EVS-EN 933-1;
1.10.3. radioactive emission – in line with the principles of EVS 901-1;
1.10.4. filtration module (on the material used in the working layer) – test method
EVS 901-20.’;
11) Clause 5 of the Annex to the Regulation ‘Basic properties of road construction materials
and the methodology to determine them’ is amended and worded as follows:
‘5. For geosynthetic materials in the meaning of EVS-EN-ISO 10318 used in the management
of public roads, according to standards: EVS-EN 13249; EVS-EN 13251; EVS-EN 13252;
EVS-EN 13253; EVS-EN 13254; EVS-EN 13255; EVS-EN 13491; EVS-EN 15381; EVSEN 15382 in a harmonised version (Commission communication in the framework of the
implementation of Regulation (EU) No 305/2011 of the European Parliament and of the
Council of 9 March 2011 laying down harmonised conditions for the marketing of
construction products and repealing Council Directive 89/106/EEC) or in European Technical
Report EOTA TR 041, all basic properties must be determined and declared as per the
function required in road management.’;
12) Annex to the Regulation ‘Basic properties of road construction materials and
methodology to determine them’ is supplemented with Clauses 7.1.1-7.1.12 worded as
follows:
‘7.1.1. resistance to water – test methods EVS-EN 14694 and EVS-EN 14223;
7.1.2. tensile properties – maximum tensile strength and elongation – test method EVSEN 12311-1;
7.1.3. adhesive strength – test method EVS-EN 13596;
7.1.4. ability to fill cracks – test method EVS-EN 14224;
7.1.5. compatibility – test method EVS-EN 14691;
7.1.6. flexibility after ageing at low temperature (EVS-EN 1109) – test method EVSEN 1296;
7.1.7. shear strength – test method EVS-EN 13653;
7.1.8. resistance to heat upon application of asphalt – test method EVS-EN 14693;
7.1.9. resistance to asphalt compression – test method EVS-EN 14692:2005;
7.1.10. resistance – test methods water absorbance EVS-EN 14223, flexibility after ageing at
low temperature (EVS-EN 1109) – test method EVS-EN 1296 and resistance to flow after
ageing at high temperature (EVS- EN 1110) – test method EVS-EN 1296 and compatibility –
test method EVS-EN 14691;
7.1.11. hazardous substances content – asbestos, tar;
7.1.12. thickness – test method EVS-EN 1849-1;’;
13) Annex to the Regulation ‘Basic properties of road construction materials and

methodology to determine them’ is supplemented with Clauses 7.1.13 and 7.1.14 worded as
follows:
‘7.1.13. surface area weight – test method EVS-EN 1849-1;
7.1.14. stability of measurements at high temperatures – test method EVS-EN 1107-1.’;
14) The introductory sentence of Clause 9.1 of the Annex to the Regulation ‘Basic properties
of road construction materials and the methodology to determine them’ is amended and
worded as follows:
‘9.1. Concrete mixtures used in the construction of bridges, viaducts, tunnels, etc. and culverts
(a product according to EVS-EN 206):’;
15) Clause 9.1.4 of the Annex to the Regulation ‘Basic properties of road construction
materials and the methodology to determine them’ is amended and worded as follows:
‘9.1.4. maximum chloride content – chloride content class according to EVS-EN 206;’;
16) Annex to the Regulation ‘Basic properties of road construction materials and
methodology to determine them’ is supplemented with Clause 9.1.6 worded as follows:
‘9.1.6. environment class based on environmental conditions – environment class according to
EVS-EN 206.’;
17) Annex to the Regulation ‘Basic properties of road construction materials and the
methodology to determine them’ is supplemented with Clauses 10–11.5 worded as follows:
‘10. At least the following properties shall be determined and declared for barriers to
traffic noise according to their area of use:
10.1. Noise walls (and the noise barrier panels used in their construction) (a product
according to EVS-EN 14388):
10.1.1. sound absorption – test method EVS-EN 1793-1;
10.1.2. isolation of air noise – test method EVS-EN 1793-2;
10.1.3. normal (900) burden tolerated by an acoustic component (wind and static) – test
method EVS-EN 1794-1 Annex A;
10.1.4. normal (900) burden tolerated by a structure component (wind, static exterior
and gross weight) – test method EVS-EN 1794-1 Annex B;
10.1.5. bending moment on the ground tolerated by a structure component (snow
removal) –test method EVS-EN 1794-1 Annex E;
10.1.6. normal (900) burden tolerated by an acoustic component (snow removal) – test
method EVS-EN 1794-1;
10.1.7. danger from flying debris – test method EVS-EN 1794-2;
10.1.8. expected persistence of acoustic properties (lifespan of declared acoustic
properties in different environmental classes – test method EVS-EN 14389-1;
10.1.9. expected persistence of non-acoustic properties (lifespan of declared nonacoustic properties in different environmental classes) – test method EVS-EN 14389-2.
11. At least the following properties shall be determined and declared for the stabiliserbinder according to its area of use (a product according to EVS 925):
11.1. Compressive strength – test method EVS-EN 196-1;
11.2. fineness – test method EVS-EN 196-6 Section 3;

11.3. Beginning of setting – test method EVS-EN 196-3;
11.4. volume stability – test method EVS-EN 196-3;
11.5. Sulfate content – test method EVS-EN 196-2.’.
§ 2. The following amendments are made Minister for Economic Affairs and Infrastructure
Regulation No 101 of 3 August 2015 ‘Road and road works quality requirements’:
1) The introductory sentence of Section 13, Subsection 10, Clause 1 are amended and worded
as follows:
‘(10) Cement stabilisation means stabilisation with a stabiliser-binder, cement or hydraulic
road binder (hereinafter ‘hydraulic binder’). The following requirements shall apply to cement
stabilisation:
1) a hydraulic binder shall be used as a binder in cement stabilisation. The requirements for
the binder are described in standards EVS-EN 197-1, EVS 925 and EVS-EN 13282-1;’;
2) Section 13, Subsection 11, Clause 1 is amended and worded as follows:
‘1) in complex stabilisation, bitumen emulsions whose degradation index is at least Class 3
and whose bitumen content is at least 60 % or foam bitumen whose source bitumen is
petroleum bitumen with a mark of 100/150–650/900 (if no milling chippings are used for
stabilisation, mark 70/100 may also be used) and a hydraulic binder shall be used as binders;’;
3) Section 13, Subsection 11, Clause 3 is amended and worded as follows:
‘3) the average content of the hydraulic binder shall be at least 1.5 % of the mixture weight,
and an individual sample may have at least 1.5 % of the mixture weight;’.
