DISTRICT OF PORT HARDY
BYLAW NO. 16-2005
A BYLAW TO REGULATE THE AFFIXING AND
DISPLAYING OF NUMBERS FOR BUILDINGS
WHEREAS Section 8 of the Community Charter provides that Council may by bylaw
impose requirements in relation to buildings and other structures;
AND WHEREAS Council deems it necessary to provide a visible house number for
buildings within the District of Port Hardy for emergency response purposes;
NOW THEREFORE the Council of the District of Port Hardy in open meeting assembled
enacts as follows:
1.
TITLE
This bylaw may be cited as the “District of Port Hardy Building Numbering Bylaw
No. 16-2005”.
2.
DEFINITIONS
BUILDING means a structure that is used or intended to be used for supporting or
sheltering persons or animals or property.
CLERK means the person duly appointed by Council to act as Clerk and any
person authorized to act on his behalf.
COUNCIL means the Council of the District of Port Hardy.
HIGHWAY means a street, road, lane, common road in a bare land strata lot
development and any other way open to the use of the public, but does not include
a private right-of-way on private property.
NUMBER means that number specifically assigned to a particular building by the
Clerk.
PERSON means any corporation, partnership or party and the heirs, executors,
administrators, or other legal representatives of such person to whom the context
could apply according to law.
PRINCIPAL BUILDING means a building that contains the chief or main use on a
lot.
3.
SCOPE
This bylaw applies to all land and buildings within the District of Port Hardy.
4.
APPLICATION
(a) Every person owning or occupying a principal building in the District of Port
Hardy shall, within 30 days of receipt of notification from the Clerk, affix and
keep affixed the number assigned to that building in a secure position within
thirty (30) feet of where the driveway access to the parcel intersects the

highway from which it gains access and in a position clearly visible from the
highway.

(b)
The number shall be not less than four inches (4”) in height placed on a
contrasting background.
(c)
No owner or occupant of a building or parcel which has been assigned a
number shall display or cause to be displayed, any other number than the
number assigned.
CONTRAVENTION AND PENALTIES
(a)
Every person who violates any of the provisions of this bylaw, or who
suffers or permits any act or thing to be done in contravention of this bylaw
or who neglects or refrains from doing anything required to be done by any
of the provisions of this bylaw shall be deemed to be guilty of an infraction
hereof and shall be liable to the penalties imposed. Every continuing
infraction shall be deemed to be a new and separate offence for each day
during which the same shall continue.

Any person found guilty of an infraction of any of the provisions of this
bylaw shall, upon summary conviction, be liable to a minimum fine of One
Hundred Dollars ($100), which shall be recoverable and enforceable upon
summary conviction in the manner provided by the Offence Act.
SEVERABILITY
If a court of competent jurisdiction declares any portion of this bylaw invalid, then
the invalid portion must be severed and the remainder of the bylaw is deemed
valid.
