ABSTRAKSI Adaptasi secara langsung ketentuan jual-beli biasa akan kurang tepat dan tidak sesuai dengan konteks e-commerce. Apalagi yang berkaitan dengan aplikasi program afiliasi dalam e-commerce. Oleh karena itu perlu analisis, apakah ketentuan hukum yang ada dalam hukum Islam sudah cukup relevan dan akomodatif dengan hakekat program afiliasi dalam e-commerce. atau perlu pemahaman khusus tentang hukum program afiliasi dalam e-commerce. Penelitian ini berusaha menguji konsep akad/transaksi, sistem operasional dan pengambilan keuntungan yang diaplikasikan dalam affiliate marketing, selanjutnya akan dinilai dengan pendekatan dari segi aspek hukum Islamnya khususnya dua kajian khusus yang ada dalam affiliate marketing, yaitu pendekatan akad ijārah untuk praktek pemakelaran dan akad salam dalam transaksi on-line. Studi ini mencoba menjawab permasalahan yang membuat jenis ini perumusan masalah adalah jenis penelitian lebih ke penelitian literatur (library research), yang membuat sumber membaca dan wacana di internet sebagai sumber utama. Hasil dalam affiliate marketing dalam perspektif hukum Islam adalah: aplikasi diizinkan untuk praktek seperti makelar dalam perdagangan reguler (off-line), namun karena penggunaan e-commerce yang menyederhanakan segala sesuatu, maka ada syarat, rukun dan batasan tertentu seperti adanya dua kontrak tidak boleh dalam satu kontrak dan dilarang ada praktek pemakelaran diatas pemakelaran.
