Monroe Township Recreation Area Park Agreement This Agreement entered into as of the 28th day of July , 2015, between Monroe Township, a municipal corporation, existing under the laws of the Commonwealth of Pennsylvania, with its principal office on Municipal Drive, Monroe Township, Snyder County, Pennsylvania, hereinafter referred to as the “First Party” and Kim Shemory hereinafter referred to as “Second Party”; and Whereas, First Party is the owner of certain real property in Monroe Township; Whereas, the property in question is used as a recreation area by the residents of Monroe Township and, on occasion, by other individuals and organizations; and Whereas, it is the desire of the Second Party to indemnify the First Party for any loss which it may suffer as a result of the said the Second Party’s use of the picnic pavilion area. Therefore, the parties do hereby agree as follows: 1) That the First Party, for the rental fee of $50.00 resident or non-profit organization/$75.00 non-resident does hereby authorize the Second Party to utilize the Monroe Township Picnic Pavilion #1 (off Park Road) on the date of Saturday, August 29, 2015 and between the hours of Dawn to Dusk. 2) The Second Party hereby agrees to indemnify and hold harmless the First Party against and in respect to all damages which it may sustain as a result of the Second Party’s use of the Monroe Township Recreation Area. Damages, as used herein, shall include any claim, action, loss, cost, expense, liability (joint or severally), penalty, and other damage, including without limitation, counsel fees and other costs and expenses reasonably incurred in investigation or attempting to avoid same or oppose the imposition thereof in enforcing this indemnity, resulting to any person or persons from any activity of the Second Party with regard to the use of the Monroe Township Recreation Area. Second Party further agrees to give to the First Party prompt written notice of any litigation threatened or instituted against the First Party that might constitute the basis of a claim for indemnity by the First Party. Hereby the parties have executed and intending to be legally bound by this agreement on the day and year first above written.
