WATERS OF PHILORTH MANAGEMENT GROUP
1
Purpose of Report
1.1
To obtain the formal consent of the Banff and Buchan Area Committee to (a)
amending the constitution of the Waters of Philorth Management Group in
order to reduce the quorum from four to three and (b) to enter into a revised
Agreement with Fraserburgh Feuars Managers with regard to the
Management of the Waters of Philorth area.

Background
2.1
There have been two Agreements set up with regard to the Waters of
Philorth. Attached as the Appendix to this Report is a briefing note prepared
by myself for the Waters of Philorth Management Group’s meeting of 19 th
May, 2006 advising on the Agreements.
The meeting approved my
recommendations. Subsequent to that meeting I have had a discussion with
John MacKinnon, Solicitor for the Feuars Managers agreeing the wisdom of
setting up a new Agreement, consolidating and up-dating the earlier
Agreements.
2.2
At their meeting of 19th May the Management Group also requested that a
Report be submitted to the Area Committee requesting that the constitution
be changed to allow a reduced quorum of three members. The quorum of
this Group is currently one third of the group, four members, and this is not
always achievable. The majority of members are Councillors but there is also
representation from the Feuars Managers and from SEPA.

Proposals
3.1
In accordance with the recommendation of the Waters of Philorth
Management Group the Area Committee are requested (1) to agree the
preparation of a draft Agreement with Fraserburgh Feuars Managers,
revising, consolidating and updating the previous Agreements and (2) to
accept the views of the Management Group that it would be appropriate to
reduce the quorum of the group from four to three.

This is an issue solely for the Banff and Buchan Area.

Consultations
6.1
This Report reflects the views of the Waters of Philorth Management Group.
The Council’s Environment Manager and Ecologist have also been consulted
as to the terms of this Report.

Recommendations
The Committee/Council are recommended to:1
To agree the drafting of a revised Agreement between the Council and
Fraserburgh Feuars Managers as recommended by the Waters of
Philorth Management Group and the Head of Law and Administration.
2
To approve the reduction the quorum of the Waters of Philorth
Management Group from four to three.
