Powers of the NATIONAL Government (Congress can pass laws) Expressed Power: These powers are specifically written into the Constitution Ex: Coin money, Declare War, Raise an army Implied Power: Suggested in the Constitution, but not specifically stated • Things that are necessary & proper to run the Govt, like passing drug laws Reserved Powers: Everything that is not expressed or implied goes to the states Expressed Powers of Congress • Declare War • Coin money (print & set value) • Raise Army & Navy • Issue Patents • Create Post Offices • Set weights & measures • Naturalization (citizenship) • Regulate commerce (business) between states & countries • Create Federal courts below Supreme Court • Punish Counterfeiters What about the States • Reserved Powers: Powers that are not given to the national government and not denied to the states – States have wide range of powers over many issues: – Ex: Marriage, Driving age/requirements, license doctors, lawyers, teachers, etc… Concurrent Powers: Powers that both the Federal government and the States have EX: Taxing, borrowing $$$$$$$ What about the States Supremacy Clause: The Constitution is the highest law in the land – In cases where State law conflicts with Federal law, Federal law is supreme • EX: State drug laws vs. Federal drug laws
