Contract and Warranty - 'Breeding Potential' Puppies
This is a legal, binding contract between the below listed "Seller" and "Buyer," entered into by both parties
within the State of Idaho, Kootenai County, pertaining to the listed "Puppy," on the date of___________, for the
amount of:__________
Seller (name, address, phone):
Buyer (name, address, phone):
Puppy (description):
Note: UABR registration application ('papers') given at time of sale.
Warranty: Puppy has been vaccinated against, and will be free at time of sale and for the four business days
following from serious infectious canine diseases: Canine parvovirus type 2, canine distemper, and canine
adenovirus (types 1 and 2). Please note: Seller follows an internal parasite elimination protocol ('worming'),
however a finding of internal parasites is not a 'serious disease or defect.' Buyer is responsible for follow-up
vaccinations as deemed necessary by his/her veterinarian.
Puppy will be free at time of sale and for the three years following from the listed serious canine defects which
will prevent Puppy from fulfilling its duties as a potential breeding dog: Grade one or above heart murmur, grade
two or above patellar luxation, borderline to severe hip dysplasia. While undesirable, an 'off' bite (reverse
scissors, undershot, etc) is considered 'normal' for Carlin Pinschers at this time, and is not serious defect.
An examination and diagnosis by a licensed veterinarian is required within each listed time-frame to make a
claim against this contract. For hip dysplasia, radiographs must be evaluated by either the Orthopedic
Foundation for Animals or PennHip.
If Puppy is found to meet any of the above conditions for disease or defect, an additional puppy of equal value
from Seller's next available litter of like coloration and sex, will be provided to the Buyer, at no charge
(including shipping.) Buyer may choose to keep Puppy, or return to Seller. All diagnostic and/or treatment
expenses are the responsibility of Buyer.
Should a 'breeding potential' puppy be found to have the above defects, prior to Seller providing an additional
puppy, Buyer agrees to sign a 'pet only' contract for the original puppy. Buyer understands 'pet only' contracts
have penalties for breeding, and has been provided a copy of this contract to review.
Seller is not responsible for defects occurring as a result of accidents or Buyer neglect, to include, but not limited
to: inadequate veterinary care, substandard diet, inadequate housing as appropriate for breed, or rough handling.
Breeding Soundness: Puppy is being sold as 'potential' breeding quality. Although it is unlikely to occur, there is
no guarantee or warranty should Puppy prove to be ill-suited for the task of reproduction, or—given the factors
which can effect fertility—will produce viable young. At this time, an 'off' bite (reverse scissors, undershot, etc)
does not disqualify Carlin Pinschers from being breeding quality.
Registration: Buyer agrees to use the prefix "JCF'S" when registering Puppy, to denote Seller's kennel name.
Seller will add this to the registration application prior to transfer of documents.
By signing this contract and warranty, Buyer and Seller acknowledges each has read and agree to all listed
terms, and understand this is a legally binding contract. Buyer has been emailed a copy of the 'pet only'
contract, in the unlikely event it should be needed.
