DRAFT County Executive Office/Legislative Affairs October 22, 2013 Item No. ___ Vol. XII, No. 23 County of Orange Report on Grant Applications/Awards The Grants Report is a condensed list of grant requests by County Agencies/Departments that allows the Board of Supervisors to discuss and approve grant submittals in one motion at a Board meeting. County policy dictates that the Board of Supervisors must approve all grant applications prior to submittal to the grantor. This applies to grants of all amounts, as well as to new grants and those that have been received by the County for many years as part of an ongoing grant. Receipt of grants under $50,000 is delegated to the County Executive Officer. Grant awards greater than $50,000 must be presented to the Board of Supervisors for receipt of funds. This report allows for better tracking of county grant requests, the success rate of our grants, and monitoring of County’s grants activities. It also serves to inform Orange County’s Sacramento and Washington, D.C. advocates of County grant activities involving the State or Federal Governments. The District Attorney requests authorization to accept the grant award of $386,060 from the California Office of Traffic Safety for FY 2013-14. The Alcohol and Drug Impaired Driver Vertical Prosecution Program (DUID) provides funds for the vertical prosecution of alcohol and drug impaired driving cases. On January 15, 2013, your Board authorized the District Attorney to apply for a grant from the California Office of Traffic Safety (OTS) of up to $628,326, and by Resolution No. 13-003 authorized the District Attorney or designee to sign and execute a Grant Agreement with OTS. On September 25, 2013, the District Attorney received notification of a grant award of $386,060. The District Attorney requests authorization to accept the grant award of $386,060 to enhance and expand its efforts to address the public safety threat of DUID in Orange County in Fiscal Year 2013-14. This is a competitive grant opportunity. Fiscal Year 2013-14 will be the third (3rd) year that the District Attorney’s Office applied for the federal funding apportioned to California under the National Highway Safety Act and the Safe, Accountable, and Flexible Efficiency Transportation Equity Act to augment its efforts to address the public safety threat of DUID in Orange County. The grant will provide continued funding for a prosecution team to vertically prosecute alcohol and drug impaired driving cases. The District Attorney’s Office would use grant funds to allocate four misdemeanor Deputy District Attorneys (DDA) to devote 50 percent of their time to prosecute DUID cases in Fiscal Year 2013-14. No County new positions or County match is required. The District Attorney will work collaboratively with local law enforcement agencies to reduce the number of drug impaired driving cases in Orange County. The Grant Award Agreement has been reviewed and approved by the Office of County Counsel. A copy of the agreement is filed with the Office of the Clerk of the Board. Grants Report October 22, 2013 Vol. XII, No. 23 Page 3 Ratify the Retroactive Grant Application and Adopt Resolution – OC Community Resources/OC Parks – Measure M2 Environmental Cleanup Program, Tier 2 / Stormwater Runoff Quality and Quantity Control Best Management Practices ($995,567) Requester: Grant/Program: Amount Requested: Match/Cost: Application Due Date: Grantor: OC Community Resources / OC Parks Measure M2 Environmental Cleanup Program, Tier 2 / Stormwater Runoff Quality and Quantity Control Best Management Practices (BMP) $995,567 $1,112,207/50 minimum of percent September 20, 2013 Orange County Transportation Authority (OCTA) The purpose of the Orange County Transportation Authority (OCTA) M2 Tier 2 Environmental Cleanup Program (ECP) is to help protect Orange County beaches and waterways from transportation-generated pollution (urban runoff) and improve overall water quality. The ECP Grant is designed to fund regional, potentially multi-jurisdictional, capital-intensive projects, such as constructed wetlands, detention/infiltration basins and bioswales, which mitigate pollutants including litter and debris, heavy metals, organic chemicals, sediment, and nutrients. This ECP Grant provides approximately $25.3 million to Orange County local agencies. The maximum amount that an individual project may receive is $5 million per project phase. OC Community Resources / OC Parks is requesting OCTA grant funding for the Stormwater Runoff Quality and Quantity Control Best Management Practices project in the amount of $995,567. The anticipated grant award notification is expected in late 2013. This is a competitive grant. This is the second call for ECP Tier 2 Call for Projects. There may be a third Call for Projects if there are residual funds available after the first two calls. Funds are requested to help cover costs to construct drainage improvements identified in the Irvine Regional Park Hydrology & Hydraulics report (2011) and the OC Zoo General Development Plan (2013). Drainage improvements are needed to reduce stormwater flows that currently drain into the OC Zoo that cause flooding, and to improve stormwater retention, infiltration, filtration and natural treatments to improve water quality and reduce pollutants entering the Santiago Creek. The project promotes natural enhancements for native flora and fauna improving the ecosystem, pollutant biofiltration, and outdoor recreational and educational opportunities. OC Parks will oversee and obtain contractor services for the implementation of the project. OC Parks will not require any new positions to process and utilize the Grant funds. A minimum local match of 50 percent for the total project cost is required. The total preliminary construction cost estimate is $2,107,774. Subtracting the requested grant amount of $995,567, the proposed local match will be $1,112,207. This project is included in the OC Parks Capital Project Budget fiscal year 2013/2014. OC Parks collaborated with OC Public Works to submit this grant application under the OCTA Renewed Measure M Eligibility Authority of OC Public Works (OCPW); OC Parks will maintain and operate the equipment acquired and installed. There are no potential impacts to OCPW. A Board of Resolution is required for this grant. The attached general resolution has been approved by County Counsel.
