Therefore, for any goods sold to a production company located in a participating HST province, the applicable HST rate will be charged. For non-HST provinces, the GST will be charged. For clarity, tangible goods are physical assets such as vehicles and equipment. 2) Place of Supply Rules for the Provision of Services The place of supply rules for the collection of HST/GST on services rendered will be based (first and foremost) on the provincial address of the recipient of the supply most closely connected with the supply of the service. In the majority of cases for film and television productions, the place of supply address of the recipient will be the main production office. Accordingly, the HST/GST will be charged at the applicable rate for the province in which the production office is located. Goods and Services Tax and Harmonized Sales Tax Production’s Input Tax Credits (ITCs) In most cases, a full ITC is available on HST and GST paid on the purchase of goods and the provision of services (see the exception for “large businesses” discussed below). Production companies in Ontario and PEI that were previously required to absorb the PST as a cost under each province’s respective tax legislation will now realize a savings with the Harmonized Sales Tax. PST that has been included in the new HST rate will be fully refundable to the extent it is not considered a tax on specified services and property, as noted below. Transition Rules for Large Businesses- Recaptured ITCs The following only applies to Ontario and PEI based Production Companies A detailed set of transitional rules apply to associated groups of companies with taxable revenue of more than $10 million annually (collectively defined as a “large business”). These businesses would be required to 'recapture' ITCs attributable to the provincial component of HST in Ontario (8%) and PEI (9%) and that becomes payable, or is paid, in respect of “specified property and services” acquired or brought into Ontario or PEI by a large business for use by that business in the province. Please note that the transition rules for large businesses are complex and all productions should seek accounting and tax advice to determine if the production company is (by definition) part of a large business and to ensure the proper recording and reporting of the HST and ITCs. “Specified services and property” are defined as: 1) 2) 3) 4) Energy Telecommunication services (except for the cost of internet and the cost of toll-free numbers) Road vehicles weighing less than 3,000 kilograms, vehicle parts and certain services, and fuel (except for the cost of diesel fuel to power those vehicles – this exception applies in Ontario only) Food, beverages and entertainment Businesses subject to the recaptured ITC requirement will have to separately identify the recaptured ITCs in their GST/HST filings. At the time of contracting of Performers, the Producer must declare the intended declared Use of the Production. (a) Theatrical worldwide Theatrical Use for period of copyright of the Production (b) Free Television one (1) domestic run in Canada (c) Pay Television one (1) year’s Use in Canada (d) Cable Television three (3) years’ Use in Canada (e) Compact Devices two (2) years’ Use in Canada (f) Educational Television three (3) years’ Use in Canada RESIDUAL PAYMENTS When a Production is exploited in a market other than the market provided for in the declared Use and the Producer has elected not to adopt the Use payment system in Article B5, Performers shall be paid the following minimum Use fees based upon the following precentages of Net Fees earned during the production of the Production. Use fees shall be paid within thirty (30) day of the date of such Use. Theatrical Use When a Production produced with a declared Use of Free Television, Pay Television, Cable Television, Compact Devices, or Educational Television is distributed for theatrical Use, the Producer shall pay to Performers the following percentages of the Performers' Net Fees for unlimited theatrical Use: (a) productions sixty (60) minutes or less in length 15% (b) productions exceeding sixty (60) minutes in length 35% Free Television (a) Use in Canada (i) each domestic run 30% (ii) each Use on a single television station: Toronto/Hamilton all other stations 20% 10% When the aggregate of payments to the Performer for Use under subparagraph (a)(ii) has reached thirty percent (30%) of the Performer’s Net Fees, the Producer shall be entitled to authorize broadcast of the Production one (1) time on one (1) television station in each market in Canada in which the Production has not been so used. The Producer shall declare and specify the prepayment in the individual contract of the Performer. The prepayment must be paid to Performers at the time of production.
