Fall 2009 Manure Application Points of Interest MANURE APPLICATION NOT AFFECTED BY NEW LAW Manure to snow covered and frozen ground law (SF432, Division I; access at http://coolice.legis.state.ia.us/CoolICE/default.asp?category=billinfo&service=billbook&GA=83&hbill=SF432 ) does not apply to: -open feedlots -confinement operations that are Small Animal Feeding Operations (SAFOs) -solid manure -liquid manure not surface applied (appropriately injected or incorporated), regardless of time of year -liquid manure surface applied to frozen ground before Feb. 1 or after April 1 -liquid manure surface applied to snow covered ground before Dec. 21 or after April 1 The new law does apply to confinement operations with at least 1250 finishing pigs or sows, 500 beef cattle or young dairy cattle or 350 mature dairy cows or combinations of animal types to total 500 animal units. FALL MANURE APPLICATION CONCERNS full pits and no place or proper conditions to land apply -can manure be transferred to available manure storage structures until land application can occur? -can temporary manure storage containers be used to store manure until land application can occur? -call the appropriate Field Office to work through possible options EMERGENCY Defined as immediate need to avoid manure storage overflow due to unforeseen circumstances beyond the control of the owner including but not limited to natural disaster, unusual weather conditions, or equipment or structural failure. Emergency manure application to snow covered ground between Dec. 21 and April 1 or frozen ground between Feb. 1 and April 1 -contact the Field Office for the region the facility is located in by telephone to inform of the emergency (provide name and contact information if leaving a message) -block surface tile intakes in fields in the MMP down gradient of the manure application prior to application and for at least 2 weeks after application -apply only to fields identified in the MMP as appropriate for emergency application (Phosphorus Index of 2 or less) -meet all required separation distances for surface application COMMERCIAL APPLICATORS Commercial applicators may want to contact their clients to see which clients have fields appropriate for emergency application and schedule manure application accordingly. Some producers may need to add fields to MMPs so they have fields appropriate for emergency application. WRITTEN APPROVAL REQUIRED FOR SOME PERMITTED OPERATIONS Operations that have construction permits with a condition relating to master matrix item 26(e) requiring injection or incorporation of manure on the same date it is land-applied will need written DNR approval if injection or incorporation is not possible. MINIMUM MANURE CONTROL ALWAYS REQUIRED Water quality violations ARE NOT ALLOWED regardless of time, location or method of manure application.
