ORDINANCE NO. 2546-15
AN ORDINANCE DETERMINING THE ADVISABILITY OF THE SHADOW OAKS
SUBDIVISION SECOND ADDITION NEIGHBORHOOD IMPROVEMENT DISTRICT PROJECT,
IN THE CITY OF CAMDENTON, MISSOURI; ORDERING THE CREATION OF A
NEIGHBORHOOD IMPROVEMENT DISTRICT FOR SAID PROJECT; AND ORDERING AN
ASSESSMENT ROLL TO BE PREPARED AND A HEARING TO BE HELD ON PROPOSED
ASSESSMENTS FOR SAID PROJECT.
WHEREAS, pursuant to the authority of Sections 67.453 to 67.475, inclusive, RSMo, titled the
Neighborhood Improvement District Act (the “Act”), proceedings have been undertaken for certain
improvements for a neighborhood improvement district in the City of Camdenton, Missouri; and
WHEREAS, a petition signed by the owners of property within the proposed neighborhood
improvement district has been filed with the City Clerk requesting improvements designated as
the Shadow Oaks Subdivision Second Addition Neighborhood Improvement District Project (the
“Project”), said petition stating (a) the project name for the proposed improvements, (b) the nature
of the proposed improvements, (c) the estimated cost of the proposed improvements, (d) the
boundaries of the proposed neighborhood improvement district to be assessed and (e) the
proposed method of assessment; and
WHEREAS, said petition has been examined by the City Clerk and found to have been signed by
the owners of more than two-thirds by area of all property within the proposed district:
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF
CAMDENTON, MISSOURI, AS FOLLOWS:
Section 1. The Board of Aldermen of the City hereby finds and determines that the petition
requesting the Project is complete and proper in all respects.
Section 2. The Board of Aldermen finds and determines that the Project is advisable and orders
a neighborhood improvement district to be established for the Project.
A. The project name for the proposed improvements is Shadow Oaks Subdivision Second
Addition Neighborhood Improvement District Project.
B. The general nature of the proposed improvements is to design, construct and inspect for
City acceptance the curb and gutters necessary to complete the Clint Avenue Street
Improvement Project in accordance with plans on file with the City.
C. The estimated cost of the proposed improvements is $18,000. The final cost of such
improvements assessed against the benefited real property within the district and the
amount of general obligation bonds of the City issued or obtained shall not exceed, without
a new petition, such estimated cost by more than twenty-five percent (25%).
D. A boundary description and map of the proposed neighborhood improvement district are
attached hereto as Exhibit A. The district is located entirely within the City of Camdenton,
Missouri, an incorporated city.
E. The proposed method of assessment is on a per lot basis, excluding any public land,
easements and rights of way, to the property owner or owners of real property within the
proposed neighborhood improvement district. This assessment will not include any
annual assessment of maintenance costs for the improvements. These special
assessments shall be payable in substantially equal annual installments over a period of
ten years.
Section 3. The improvements included in the Project are hereby authorized. The City Clerk is
ordered and instructed to:
A. Prepare an assessment roll for the Project based on the portion of the estimated cost of
the Project to be assessed against property owners and the method of assessment
described above;
B. Fix a date for a hearing to be held by the Board of Aldermen on the Project and the
proposed assessments;
C. Publish notice of such hearing in compliance with the Act, said publication to occur not
more than twenty days and not less than ten days before the hearing date; and
D. Mail notice of such hearing to each owner of record of property within the District pursuant
to the Act.
Section 4. This Ordinance shall be in full force and effect and be in full force from and after its
passage by the Board of Aldermen.

subdivision as recorded in Plat Book 15 at Page 75, a distance of 615.18 feet to a 3/8” bar,
returning to the North line of the Northeast Quarter of the Southwest Quarter; thence leaving said
East line and following said North line, North 88 deg 56 min 04 sec East, a distance of 535.38
feet to the POINT OF BEGINNING; said described tract containing 5.8 Acres, more or less.
