ARTICLE I. NAME
A. Kansas State Paintball
ARTICLE II. PURPOSE
A. Kansas State Paintball shall provide the students of Kansas State University
with the opportunity to play at a discount at local fields and to harvest friendship
amongst players. Kansas State Paintball shall also provide the possibility of
playing on a tournament team that shall be competitive amongst teams in the
NCPA around the nation.
ARTICLE III. MEMBERSHIP
A. Any person shall be eligible for membership of Kansas State Paintball
B. Only full time students shall be eligible to play on the Competitive team
C. Any person can associate themselves with Kansas State Paintball by showing
up and playing with others who are also affiliated with Kansas State Paintball. To
be a member of the competitive team shall require the actions stated in By-Laws
Section B; Numbers 1- 7.
D. A full member has the right to wear a sanctioned Kansas State Paintball jersey
and to compete in tournaments with the Kansas State Team. A full member also
has one vote to cast on issues brought forth to Kansas State Paintball.
ARTICLE IV. MEETINGS
A. Meetings shall be held when called by 3 or more members of Kansas State
Paintball or when the President or Vice President deems it necessary.
B. Email shall be an intrinsic part of calling meetings as well as word of mouth
between players. A preferable amount of time shall be given to team members to
account for such a meeting in their school schedules.
ARTICLE V. EXECUTIVE BOARD
A. There shall be a President, a Vice President, a Treasurer, and a Secretary.
B. Whomever is elected President shall pick his or her executive board.
C. Officer duties shall be included in By-Laws Section C; Numbers 1 – 4.
ARTICLE. VI. ELECTIONS
A. Only the President shall be elected by membership. Presidential candidates
shall follow candidate rules as stated in By-Laws Section D; Number 1. The
President shall be in office as long as members elect him wish to re-elect him or
her for a period of one school year, and given the following year shall not be said
persons last year in school.
B. A person shall nominate themselves any time after the resignation of the
President in the fall semester of a given school year with intentions of being
President for the following school year.
C. Nominees shall have a chance to present themselves at a Kansas State Paintball
meeting at which there are no more than two members not in attendance.
D. Nominees shall not be able to vote. The current President shall not vote,
except in case of a draw. In which case the President shall consider heavily the
instructions in By-Laws Section C, Number 1 in order to make the final
decision.
ARTICLE VII FUNDS
A. Members of previous standing shall have until the first event to pay their $20
dues as in such they have shown commitment to Kansas State Paintball
previously. New members shall have their $50 dues paid within the first 28 days
of their attendance at Kansas State as their commitment has not yet been able to
be justified.
B. The President shall have a plan of action for club funds before the beginning of
the fall semester of school for the entire year. The President shall also have a plan
of action for fundraising. If three or more members disagree with the plan of
action then the team shall meet within the first week of school and discuss the
plan. Members who disagree shall have their ideas for changes in the presented
plan of action or a plan of action of their own ready to be presented at the
meeting. Knowledge of funds and voting on such use shall follow by the rules of
By-Law Section E; Numbers 1 - 2.
ARTICLE VIII. COMMITTEES
A. Committees shall be created as the need arises.
ARTICLE IX. AFFILIATIONS
A. Statement of current affiliations
1. Kansas State Paintball is affiliated with the National Collegiate
Paintball Association.
2. Kansas State Paintball is also receiving sponsorship from Smart Parts.
3. When included in Class AA college paintball Kansas State Paintball is
currently associated with the Great Plains Intercollegiate Conference.
4. Should any other sponsorship be applied to the team, they shall be listed
here.
B. Kansas State Paintball will adhere to the rules of the National Collegiate
Paintball Association as stated by their website at www.college-paintball.com.
ARTICLE X. ADVISOR
A. The function of the Kansas State Paintball advisor shall be to help guide the
young men and women of Kansas State Paintball in good moral directions in the
dealings of an organization. It is preferred that the advisor shall have paintball
experience in one form or another. If such candidate is not available, the advisor
should be a person of good ethical standing and sound judgment. This person has
the obligation to inform Kansas State Paintball of any information he or she
comes across that would be of interest to the team. The advisor shall do so
through the President or Vice President.
ARTICLE XI. COACH/INSTRUCTOR
A. Should the need arise for a Coach/Instructor for Kansas State Paintball; the
team shall first look within itself for a volunteer who would be willing to do so.
The team shall not fund said position related to coaching or instructing the team.
Should the need arise for such a position the team shall look for someone who has
a love for the game and would be willing to spend time with the team. Otherwise,
the team shall nominate from within itself a person or persons who shall develop a
strategy and course of practice. Once said person has been determined the team
shall follow said members plan unless a majority of team disagrees with plan.
The team shall not remove said member for reasons of personal preferences on
how to prepare the team for play.
ARTICLE XII. RATIFICATION
A. The Constitution shall be approved by ¾ of the members for ratification.
ARTICLE XIII. AMENDMENTS
A. Any amendments to the Constitution shall be presented at a meeting with
foreword knowledge given to the President and Vice President to evaluate its
intent and how it would affect any relationships, actions, procedures, and purpose
it would give Kansas State Paintball. An amendment shall be voted upon at the
meeting following the one it is presented at. Such meeting shall be held within 10
days of presentation. A ¾ vote is required when said amendment changes any
intent or wording of current constitution. Such a situation shall be determined by
the Executive Board. When not affecting any current status of the Constitution it
shall be ratified by a 2/3 vote.
ARTICLE XIV. BYLAWS
A. Voting
1. Voting by a ¾ or 2/3 decision shall require the meeting of said deciding
factor or besting it. Rounding up to a ¾ or 2/3 decision does not constitute
a ratified decision. Quorum is considered 2/3 of voting members.
Quorum must be met in all voting situations. Other situations may
supercede Quorum, but Quorum must always be met. Members unable to
attend may proxy their vote to another member with foreword knowledge
given to said member and the President.
B. Membership
1. Member must be a full time student or graduate student.
2. Member must pay $20 for return membership or $50 for new
membership. Dues are such because of shown commitment.
3. Member must have or purchase team jersey.
4. Member must attend weekly study sessions with the team.
a. Should a member miss 5 study sessions a semester or 9 over a
two semester period for anything to be determined unreasonable by
the Executive Board in a majority decision, said member shall be
removed from team status.
b. Said member shall be eligible for team status after one event and
only during the next semester. If said one event shall be the only
event in the next semester after violation has occurred, said
member shall be allowed to play with majority voting by team and
only as a reserve player and if said member makes it to the
remaining study sessions as required by Article XIV; Section A,
Number 4, letter a.
5. Member must attend practices and be able to buy or bring one bag of
500 paintballs for each practice. Should any member miss 4 practices in a
semester or 7 in two semesters the enforcement shall be as in Article
XIV; Section B, Number 4, letters a and b but only in consideration of
practices.
a. Practices shall be scheduled with consideration of sponsorship
and personal funds.
6. Practice and study sessions shall be considered two separate issues
when it comes to violating either of them.
7. Member shall remain in good standing with all laws within City,
County, State, and Federal regulations. Should a member violate any law
that is considered a serious grievance by the team with a 2/3 decision, said
member shall be eliminated from the team with no eligibility to play again
on the team.
8. Any member violating a team contract or agreement when the team has
agreed to follow said contract or agreement, shall be first warned, than
stricken of privileges, and finally removed from team in successive
violations
C. Officer Duties
1. President/Vice President: The office of the President and Vice
President shall hold the responsibility of submitting all paperwork to the
University in prompt manner. It shall also hold the responsibility that
team members comply with all contracts or agreements.
2. Secretary: Shall have written accounts that will be added into the
Actions Section of the Constitution. Such items will include purposes or
intentions of team up and through the times those actions are completed.
Items shall than be listed as complete and kept on record for future
reference. The Secretary shall also keep track of voting at meetings and
any change in the Constitution shall be recorded in the Constitution by the
Secretary.
3. Treasurer: Shall keep an updated record of available funds from the
University. Treasurer shall also keep track of any donations, amounts and
dates, received from any outside source of the team or University for
future reference. Treasurer shall also keep track of who has paid dues.
The Treasurer shall report to the team on available funds at every meeting.
4. Tournament Captain: The office of Tournament Captain shall have
the responsibility of reporting to the team potential tournaments and
coordinating with the treasurer as to what funds are available. The
Tournament Captain shall also be responsible for scheduling practices
with reason and determining what occurs based on what the team wants.
D. Candidacy for President
1. Candidates shall not slander, mud sling or any other political jargon
way of badmouthing another candidate. Candidate shall focus on their
plans for the club and how they plan on going about them and why they
would be a good choice. They shall also declare who their Executive
Board would be should said Candidate win. The candidate shall not be
graduating within the next two semesters.
E. Knowledge of Funds
1. The determination on how funds shall be spent shall be produced in a
plan by the President before the beginning of the fall semester. Said plan
shall be approved of by a majority vote by remaining members from
previous year. New members shall not be present or able to vote of how
funds shall be spent.
2. Once the determination of how funds shall be spent it shall be made
known to new members within 48 hours by email or written word.
F. Impeachment of Officers
1. Any officer of the team shall be under the ability to be impeached. At
any meeting any member in good standing shall call for a vote of
confidence. This motion must be seconded by another member. The
member who brings the motion to the table must then present a reason for
a vote of confidence. Discussion shall ensue after the initial presentation
with each member being allowed to speak a maximum of twice on the
issue. A failing of a vote of confidence of said officer would mean a lack
of confidence in that officer’s ability by the team.
2. Only after a vote of no confidence has been held can an officer be
impeached. A motion of impeachment must be brought forth and
seconded. Said motion cannot be brought forth in the same meeting as a
vote of confidence on any one officer. A presentation by the member who
makes the motion shall follow the seconding of the motion. Discussion
shall follow the presentation with each member being allowed to speak
twice on the issue. A vote of 2/3 must be met for impeachment. The
Officer under question shall not be allowed to vote on the issue.
3. Any successful impeachment will result in the loss of duty of any
officer. It does not remove them from the team. Any officer other than
the President must then be approved by the team in a majority vote for
replacement. The President shall ask for volunteers and shall not be
allowed to choose their replacement.
a. Should the President be impeached then rules for Presidential
candidacy shall ensue with the Vice President acting as the
President de facto until an official President is elected.
4. In special circumstances the President may see fit to remove a member
from an officer position. The President must give sound reasoning as to
why such an action is necessary and requires only a lesser majority vote of
2/5.
G. Removal of Members
1. It should be noted that members may become detrimental to the team. In such
a case any member of the team shall be able to bring forth a motion for a
member’s removal. It shall require a seconding. Reasoning shall be provided by
the member who brought forth the motion and discussion shall ensue. Each
member shall have two opportunities to speak on such an issue. At the following
meeting within 10 days a vote shall be taken with no more than 2 members not in
attendance. Such an action shall require a 2/3 vote with the Vice President
counting as two votes and the President not voting.
a. Should such an action occur and be successful, said member asked to
be removed shall leave the meeting immediately and will not be refunded
any dues or monetary donations. Any member asked to leave shall be
required to return any items that belong to the team as a whole within 5
days to the President or it will be considered theft and a police report shall
be filed.
2. The President and Vice President shall have only one statement in the
discussion and move to guide the discussion in an effective and as a humane way
as possible.
H. Practices
1. Practices shall consist of 1 and ½ hours worth of play or drill. Refusing to play
or drill shall be considered the same as missing a practice. Members are
encouraged to play as much as they can afford. However, playing too much and
depleting their funds in such a way they cannot practice or afford to play in
events/matches/tournaments shall be deemed inappropriate and shall not be an
excuse for not being able to practice. Players are encouraged to watch their
extended expenses as to allow themselves money to practice.
a. Reballs shall be held in possession at the recreational facilities. They
shall not be held by any member at any time except for the period
immediately after the purchase and before reballs can be stored.
i. Equipment shall be concealed at all items until in small gym.
Any player in violation of this can be potentially arrested.
b. All members shall contribute $20 to the team funds for the use of
reballs. Any person not on the team will be able to practice with KSU
team reballs for a fee of $25 per semester. They shall be allowed to use
reballs after team practice is over under the eye of at least two KSU
players.
i. If the person who has already paid a $25 fee and is invited to
play on the sponsored team, they shall not be required to pay
another $20 for the use of reballs.
I. Special Considerations
1. Any ability not directly written out shall be with the inherent ability of the
Executive Board to insure fluidity of the team.
