“The New Paris” Sweepstakes Official Rules NO PURCHASE NECESSARY TO ENTER. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. 1. TIME PERIOD: The New Paris Sweepstakes (“Sweepstakes”) begins at 7:00PM (EST) on April 19, 2017 to 11:59PM (EST) on May 17th, 2017 ("Sweepstakes Period"). Sponsor: Societe Air France (“Air France” or “Sponsor”), a French company with its United States Executive Offices located at 125 W 55th Street, Second Floor, New York, NY 10019. 2. ELIGIBILITY: The Sweepstakes is only open to legal residents of the United States who are at least eighteen (18) years old as of the date of entry. Employees of the Sponsor or any other party associated with the development or administration of this Sweepstakes, including but not limited to employees of affiliates, subsidiaries and joint venture partners, and the immediate family (i.e., parents, children, siblings, spouse), and persons residing in the same household as such employees, are not eligible to enter or win. Individuals who have won any Sweepstakes or Contest in the last three (3) years sponsored by Air France, KLM Royal Dutch Airlines, their affiliates, subsidiaries or joint-venture partners, or any Sweepstakes or Contest where the prize awarded was provided by Air France, KLM Royal Dutch Airlines, their affiliates, subsidiaries or joint venture partners are not eligible to enter this promotion. 3. HOW TO ENTER: There are two (2) ways to enter: 1) Online: visit https://www.airfrance.us/US/en/local/customer/webform.do?webformId=thenewparis and complete online entry form. Online entries must be received no later than May 17, 2017 at 11:59:59 p.m. EST. 2) By Mail: Mail a 3”x5” card on which you have legibly hand printed your first and last name, complete mailing address (street, city, state, zip code), telephone number, email address (if applicable), in a handaddressed envelope with first class postage affixed to: The New Paris Sweepstakes, 125 W55th St, Second Floor, New York, NY 10019. Mail-in entries must be postmarked no later than May 17, 2017 and received no later than May 24, 2017. No mechanical reproduction of entries or facsimiles is permitted. Limit of one (1) entry per person, regardless of method of entry. 4. WINNER SELECTION/NOTIFICATION: Each entrant must comply with all terms and conditions set forth in these Rules, and winning is contingent upon fulfilling all requirements. One (1) winner (“Winner”) will be selected randomly from all eligible entries on or about May 18, 2017. Winner will be contacted via email by the Sponsor by May 19, 2017 at 5:00 PM EST. If Winner does not respond to Sponsor within five (5) business days, Sponsor may deem that Winner has forfeited his or her right to any prize and an alternate winner will be selected at random from all eligible entries received at the sole discretion of Sponsor. Winner will be required to sign an Affidavit of Eligibility and Liability/Publicity Release ("Release") and Assignment of Rights ("Assignment") within ten (10) days after the notification date, which will require verification of Social Security number/s for tax purposes and an IRS Form as well as Evidence of Ownership and Required Permission forms (‘Forms") from Third Party Participants or others as determined in the sole discretion of the Sponsor. Failure to supply the requested information or complete the necessary Forms will result in forfeiture of all rights to the prize and the selection of an alternate winner. Upon contacting a potential winner and determining that he/she has met all eligibility requirements of the Sweepstakes, including without limitation the execution of required waivers, Releases, Assignments and any other required documentation, including Evidence of Rights, such individual will be declared the Winner of the Sweepstakes. Winner’s travel companion will also be required to sign a Companion Release prior to travel. If the potential travel companion is a minor in the state in which s/he resides ("Minor"), the Release must be signed by that Minor’s parent or legal guardian on the Minor’s behalf. Travel companion must be at least fourteen (14) years old at time of travel or traveling with a parent or legal guardian. All expenses associated with parent/legal guardian travel in accompanying a minor travel companion will be the sole responsibility of the traveling companion and/or Winner. Once all documentation is returned to the Sponsor and the Winner is verified, the Prize will be awarded. The Sponsor reserves the right to modify the notification procedures in connection with the selection of alternate winners, if any. 5. PRIZE DESCRIPTION: The Winner will receive a trip for two (2) to Paris, France. Prize consists of: Two (2) Air France round-trip Economy class tickets (one set for Winner, one set for Travel Companion) from an Air France USA gateway (ATL, BOS, DTW, IAD, IAH, JFK, MIA, LAX, ORD, SFO, MSP) to Paris (CDG), France. 1 copy of The New Paris by Lindsey Tramuta A 1-night stay or meal for 2, depending on availability, at Hôtel Providence A weekend brunch or weekday meal for 2 at Belleville Brûlerie Lunch for 2 at The Beast A set of Jamini notebooks 2 tote bags from Sept Cinq The aforementioned components constitute the “Prize”. Approximate retail value of Prize: $8,500.00; Winner and travel companion shall be responsible to pay all applicable individual taxes related to the acceptance and use of the Prize. Relative to the Air France round-trip Economy class tickets, Winner and travel companion may depart solely from an aforementioned Air France USA gateway and the return flight must originate from Paris (CDG) only. In the event that at time of Winner’s travel dates Air France no longer operates from the such the original gateway, tickets will have to be reissued departing from another USA gateway where Air France still operates with Winner/travel companion shall be responsible for all costs associated with transportation to and from the outbound Air France USA gateway. The Air France round-trip Economy tickets are only valid for Air France operated flights (i.e. no codeshares) and may not be applied towards accruals for any frequent flyer or similar-type program. Tickets may be subject to certain restrictions, including without limitation, availability and blackout dates; Sponsor will attempt to accommodate the Winner’s preferred dates but has no obligation to do so and all specifics thereof will be at Air France’s sole discretion. Air France flight numbers and dates of travel for the Winner’s traveling companion must mirror those of the Prize Winner (i.e. they must travel together); all terms and conditions attached to Winner’s travel shall also apply to travel companion. The routing of the Economy class tickets must be direct to Paris (CDG). No additional travel is allowed with the Economy class tickets; segments other than the flight to the destination cannot be added to the tickets. Air France will report value of prize as required by law. Travel must be booked at least three (3) weeks before the departure and no sooner than 6 months prior to departure date. All travel must be completed no later than April 30 2018. Once issued, tickets cannot be changed or modified. Economy class prize tickets are nonrefundable, nontransferable, not for sale, and no substitution by Winner and travel companion or cash equivalent is allowed, except at Air France's sole discretion. Economy class prize tickets are not valid for upgrades. Sponsor will not replace any lost, mutilated, or stolen tickets or travel vouchers and is not responsible if the trip is delayed, postponed, or cancelled for any reason. Winner and travel companion are responsible for obtaining all necessary travel documentation including passports and visas. Arrangements for the fulfillment of the Economy class tickets will be made by Air France. Only after all required documentation is returned to the Sponsor and the winner is verified will the applicable Prize be awarded. Failure to comply with all terms and conditions will result in forfeiture of the Prize. Extensions are not permitted at any time. The Sponsor reserves the right at its sole discretion to substitute the Prize (or any prize component) with another prize of equal or greater value. 6. USE OF DATA. Sponsor will be collecting personal data about participants (including, without limitation, name and email address), when they enter the Sweepstakes. By participating in the Sweepstakes, entrants hereby agree to all personal information uses and disclaimers as explained in Sponsor’s privacy policies located at: http://www.airfrance.us/US/en/local/transverse/footer/edito_psc.htm By accepting the Prize, Winner grants Sponsor the right to use, publish, including post online, his or her name, likeness, voice, opinion, biographical information, and place of residency in any media for advertising and promotional purposes without additional compensation, except where prohibited by law. 7. INDEMNITY: Participants agree to these Official Rules and the decisions of the judges and the Sponsor, and on their behalf, and on behalf of their respective heirs, executors, administrators, legal representatives, successors and assigns ("Releasing Parties"), release, defend and hold harmless the Sponsor, together with Sponsor’s affiliates, subsidiaries and joint venture partners (“Sponsor Entities”), as well as the employees, officers, directors and agents of each (collectively referred to as "Released Parties"), from any and all actions, causes of action, suits, debts, dues, sums of money, accounts, reckonings, bonds, bills, specialties, covenants, contracts, controversies, agreements, promises, variances, trespasses, lost profits, indirect or direct damages, consequential damages, incidental damages, punitive or exemplary damages, judgments, extent, executions, claims and demands whatsoever, in law, admiralty or equity, whether known or unknown, foreseen or unforeseen, against Released Parties which any one or more of the Releasing Parties ever had, now have or hereafter can, shall or may have which in any way arise out of or result from entrant’s participation, acceptance and use or misuse of any prize, including any travel related activities. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of any prize. 8. LIMITATION OF LIABILITY: Participants assume all liability for any injury, including death or damage caused or claimed to be caused, by participation in this Sweepstakes or use or redemption of any Prize. Any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, shall be resolved individually, without resort to any form of class action. Any claims, judgements and/or awards shall be limited to actual out-of-pocket costs associated with entering this sweepstakes entrant hereby waive any rights or claims to attorney’s fees, indirect, special, punitive, incidental, or consequential damages of entrant, identifiable persons, or third party participants, whether foreseeable or not and whether based on negligence or otherwise. Caution: any attempt to deliberately damage KLM and Sponsor web sites or undermine the legitimate operation of the sweepstakes may be in violation of criminal and civil laws and will result in disqualification from participation in the sweepstakes. Should such an attempt be made, the sponsors reserve the right to see remedies and damages (including attorney fees) to the fullest extent of the law, including criminal prosecution. 9. FORCE MAJEURE: In the event Sponsor is prevented from continuing with the Sweepstakes as contemplated herein by any event beyond its control, or otherwise, including but not limited to fire, flood, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared) or any federal, state, or local government law, order, or regulation, or order of any court or other cause not within Sponsor’ control, Sponsor shall have the right to modify, suspend, extend or terminate the Sweepstakes and/or to select a Winner from among all eligible Entries received up to the date of termination or other equitable resolution in the sole discretion of the Sponsor. 10. GOVERNING LAW: This Sweepstakes shall be governed by and interpreted under the laws of the State of New York, U.S.A. without regard to its conflicts of law’s provisions. 11.
