CONSUMER PROTECTION REGULATIONS (PRICE
PER MEASUREMENT UNIT) 5768-2008
By my authority under sections 17B(e) and 37 of the Consumer Protection
Law 5741-1981 (hereafter: the Law), on a proposal by the Commissioner and
with approval by the Knesset Economics Committee, I make these
regulations:
Definition
1.
In these regulations –
"price per measurement unit" – the inclusive price per one kilogram,
one liter, one meter, one square meter of the goods.
Obligation to display price per measurement unit
2.
(a) Dealers who offer, display or sell goods specified below to
consumers shall display the price per measurement unit:
(1) goods sold in bulk;
(2) prepackaged goods, on which the quantity must be stated
under an enactment or official standard.
(b) Notwithstanding the provisions of subregulation (a), in respect of
packaged food products and packaged cosmetic products with a
weight of less than 1 kg or a volume of less than 1 liter the
measurement unit shall be 100 gram or 100 milliliter.
How the price shall be displayed

(a) The price per measurement unit shall be displayed in a clearly
visible place, in clear and legible numbers and in a manner easily
related to the goods.
(b) The price per measurement unit shall be displayed on the goods
or their packaging, or on a label or sign attached to the shelf on
which the good lie, and in respect of goods sold in a sale
transaction at a distance, as defined in section 14C(f) of the Law,
the price per measurement unit shall be displayed next to the
price of the goods.
(c) If under any enactment or official standard it is obligatory to state
the net quantity of goods, then the price per measurement unit
shall also be presented per net quantity, in the manner said in
subregulations (a) and (b).

If a dealer offers, displays or sells goods in a special sale, as defined in
section 8 of the Law, he shall state the price per measurement at the
regular price of the goods, without the conditions of the special sale; the
dealer may also state the price of the goods per measurement under
the conditions of the special sale, on condition that there is a clear
differentiation between the two said prices.
Saving of statutes

These regulations shall not derogate from the provisions of the Goods
and Services Control Order (Presenting the Price of Certain Goods)
5751-1991.
Applicability and restrictions on applicability

(a) These regulations shall apply to the offer, display and sale of
goods in stores with a floor space – other than any separated
area and places used only for storage – of more than 100 square
meters, and also to the offer, presentation and to sale
transactions at a distance, as defined in section 14C(f) of the Law.
(b) These regulations shall not apply in the following instances:
(1) the unit price is the same as the inclusive price;
(2) the goods are displayed, offered and sold at an auction;
(3) the goods are art objects or antiques;
(4) the goods are displayed in a show window;
(5) different kinds of goods are packaged together;
(6) the price of the goods was reduced because of any fault or
low quality;
(7) goods sold in vending machines;
(8) goods with a price of less than 10 agorot per measurement
unit;
(9) cigarettes;
(10) wine;
(11) medicines and food additives;
(12) bread of all kinds that is not wrapped;
(13) make-up;
(14) goods that weigh less than 100 gram and goods with a
volume of less than 100 milliliters, which are not produced in
different weights or different volumes.
Effect
7.
These regulations shall go into effect on January 1, 2009.
