PUBLIC NOTICE (Revised) FLANDERS MANSION PROJECT The City Council of the City of Carmel-by-the-Sea will conduct a public hearing on 28 April 2009 in City Hall located on the east side of Monte Verde Street between Ocean and 7th Avenues. The Public Hearing begins at 4:30 p.m. or as soon thereafter as the agenda permits. Having received the recommendations of the Historic Resources Board, the Forest and Beach Commission, and the Planning Commission, the City Council will now hold a public hearing on the above named project. The purpose of the hearing is to gather public input prior to taking action on the proposal described in this notice. Persons interested in the proposal are encouraged to review additional materials available at the Department of Community Planning and Building located at City Hall on Monte Verde Street between Ocean and 7th Avenues, phone number 831-620-2010, prior to the meeting date. Following a staff report on the project, all interested members of the public will be allowed to speak or offer written testimony. IF YOU CHALLENGE THE NATURE OF THE PROPOSED ACTION IN COURT, YOU MAY BE LIMITED TO RAISING ONLY THOSE ISSUES YOU OR SOMEONE ELSE RAISED AT THE PUBLIC HEARING DESCRIBED IN THIS NOTICE OR IN WRITTEN CORRESPONDENCE DELIVERED TO THE PLANNING COMMISSION ON OR THE CITY COUNCIL AT, OR PRIOR TO, THE PUBLIC HEARING. Proposed Action: The City Council will consider the Recirculated Final Environmental Impact Report, input from the Planning Commission, Forest and Beach Commission and the Historic Resources Board, public testimony and other relevant information and may take one or more of the actions described below. (1) Certification of a Recirculated Final Environmental Impact Report, (2) a Resolution adopting a Statement of Overriding Considerations, (3) a Resolution adopting of a Mitigation Monitoring and Reporting Program for environmental impacts and Conditions of Sale and Covenants to be recorded to run with the land, or Conditions of Lease, and (4) if the Council selects the proposed project or a sale alternative, a Resolution of Notice of Proposed Discontinuance of Public Park Land and setting a date for hearing of protests against the sale of public park land. The Council will adopt Findings to support each action.
