RULE (1)
ACQUIRED IMMUNODEFICIENCY SYNDROME/HIV
VIRUS GUIDELINES
The Friess Lake School District has established guidelines for protecting the
safety and well being of those individuals infected with HIV in accordance with
federal and state laws and recommendations made by state and national health
agencies and the medical community.
District Goals
A.
Prevent exposure to diseases in the school setting which may further
compromise health status
B.
Assure compliance with statutory regulations
C.
Protect the confidentiality of information
D.
Educate students and staff regarding Bloodborne pathogens and
control measures to reduce the potential for exposure and
transmission of disease.
Students
A student's confidential records are to be separated from other medical records
and maintained in a securely locked file in compliance with Section 168 and
118.125 of the Wisconsin Statutes. The parent, guardian or adult student
provides the information disclosure of test results regarding an HIV infected
student is forbidden unless written authorization to release.
Whenever appropriate, students infected with HIV will be allowed to attend
school in a regular classroom setting. They will not be discriminated against in
their educational needs (Wisconsin State Statutes 118.13 and P19.04, Section
504 Federal Rehabilitation Act). It is recognized, however, that an HIV infected
student may be immunodeficient and their health may be at increased risk if
other communicable diseases are present in the school setting where the student
attends. Decisions regarding alternative placement will be made individually
and in accordance with state and federal law.

RULE (2)
Staff
In accordance with legal restrictions (State Statute 103.15), the district will not
require or solicit information regarding the status of an individual with regard to
HIV. Test knowledge by the district can in no way affect the conditions or
privileges of employment. It is recognized, however, that an HIV infected staff
member may be immunodeficient and their health may be at increased risk if
other communicable diseases are present in the school setting where the staff
member is employed. It may be necessary for the district administrator to
excuse the employee from performance of their regularly assigned duties until
the threat of transmission has passed, or the district may consider other
reasonable accommodation in accordance with state and federal law, board
policy and the collective bargaining agreement.
Education and Practices
Annually district-nursing staff will conduct programs to inform staff, students
and their families regarding appropriate communicable disease prevention and
control practices. These programs will conform with the recommendations of
the city, county and state health agencies. Nursing services will address the
control and prevention of diseases such as hepatitis B and HIV (virus, which
causes AIDS). State recommended guidelines will be provided to all staff and
to the public upon request. Specifically, the OSHA Standard will be addressed
through inservices regarding bloodborne pathogens in accordance with the
district's Employee and Student Bloodborne Pathogens Exposure Control Plan.
All district staff will be required to attend the inservice programs on Bloodborne
pathogens and universal precautions. Universal precautions (Exhibit A) will be
observed by all employees in order to prevent the spread of infectious diseases
in the schools.
