Board of Directors Meeting Minutes
June 13, 2012

I.
Meeting Called to Order: TB
 The meeting was called to order by TB at 10:02 am.
II.
Approval of Minutes: JK
 May BOD Meeting Minutes
CS moved to approve, DB seconded. All BOD members approved minutes.
III.
Treasurer’s Report: HM
 1st Tennessee Investment return to a negative return.
 Property P1L061 sold - received check from title company for 2012 assessment plus interest.
 Landscaping - mulch $900.
 Number of unpaid assessments for 2012 as of June 9 are 26.
Number of unpaid assessments for 2012 owing prior years as of today are 7.
 Cash for 2012 operation at the end of month $78,542.90.
Action item: HM to create budget to actual comparison report for next meeting.
 Received legal bill for $167 to remove lien for P1L139 property. Suggestion to add legal fees to
amount of lien in the future. The board agreed.
IV.
Committee Reports
a) Access: CS
 Reflector tape was added to the gate to enhance visibility at night. This was in response to
the survey from the November HOA meeting.
 The Hawkins County Sheriff was asked to help test the opening of the gate with the use of
the siren to gain access. The test was made Friday evening June 8 th and was a success. It
was noted that the emergency vehicle has to use a certain procedure. The officer said he
would notify the rest of the Sheriff’s office and EMSA of the procedure. The Lakeway Fire
Department is supposed to have access cards.
 Subcontractor not supplying weight tickets issue - contractor still working on getting
tickets. Contractor talked to authority on roads who stated more activity is worse than less
but heavier activity. Current weight limits based on engineering consultant. Discussion
followed.
Action item: CS to continue to pursue with contractor.
b) Activities: CS
 The Chelaque Homeowners Golf Scramble was held on June 2 nd at the Clinchview Golf
Club with a hamburger and hotdog cookout following. There were 6 teams participating in
this year’s event.
c)
Architecture: DA
 65 homes have been completed.
 5 homes under construction.
 1 new welcome letter sent.
 4 homeowners submitted Tree Removal requests.
 There was a question regarding the tree removal policy. TB re-emphasized that lot/home
owners need to complete a request to remove any tree – alive or dead.
d) Communications: JK
 Nothing to report.
e)
Legal: BM
 We requested and received a Release of Lien for P1L139 property from our attorney. It has
been processed.
 Foreclosure in process for two lots – P2L122 & P2L123. Complaint forms signed and filed
with Hawkins County. Lot owner has 30 days to respond. If they don’t, the HOA will go
to court for a default judgment.
f)
Marina: DB
 Six cables were replaced on the marina and trash boom in the past month. The total cost
was $5000+.
Discovered additional cable that needed to be repaired. Discussion followed.
 Several homeowners have offered suggestions how to handle the marina slips in the event
that the covered slips are completely filled. I will provide copies of these suggestions at the
Board meeting for further discussion.
There are currently approximately 7 empty slips. There was a suggestion to get input from
lot owners. Discussion followed.
Action item: A committee was formed to create a letter to solicit suggestions from
lot/home owners. The letter will be presented to the BOD at the next board meeting.
DB and JF to be on the committee.
Action item: DB to send a letter to homeowner that submitted suggestion to inform
him the process has started.
 There is a paddle boat at the marina with no owner.
Action item: DB to send out email to see if anyone wants it. Otherwise, it will be
taken to the dump.
 It had been mentioned that during the initial sales process of Chelaque Estates' property Red
Creek Ranch may have promised certain marina boat slip rights to specific lot owners.
Upon further research by the Chelaque Board and their attorney, it has been determined that
all rights to common area including boat launch parking lot, dock and marina were
conveyed to Chelaque Homeowners' Association by Red Creek Ranch through Quit Claim
Deeds of record in the Register's Office for Hawkins County, TN. Therefore, no lot owner
has ownership rights to a boat slip.
 There was a question as to whether lot P1L107R needs to be resurveyed before it can be redivided.
Action item: Marina committee to determine if lot needs to be resurveyed.
g) Office Administration: GM
 Nothing reported.
h) Roads: JF
 Channel Point issues:
- Rock laid and problem should be taken care of.
- Jeff told his problem and how to fix it.
- Mario not in any violation – just bad drain field.
 Trees hanging down road - contact All Seasons to trim?
 Several issues with downed trees in ditches and trees encroaching on the road were brought
up. Discussion followed.
 All Season does not have the equipment to complete vertical cuts, but is willing to purchase
the equipment if they receive a commitment from the board for long term business.
Action item: JF to have All Seasons attend the next meeting.
V.
Old Business
 P2L073 – Lot owner storing logs on adjacent lot. TB gave 6 months to remove logs on other
property. Lot owner has not responded and has not removed logs.
Action item: CS to talk to lot owner.
 P2L086 – Lot owner has car illegally parked on lot.
Action item: BM to look at violations.

VI.
There are several dogs running loose in the development. Discussion followed. It was
reiterated that based on the covenants, all dogs must be under control of the owner at all times.
New Business
 Internet Access in Chelaque
There are several options available: dial-up, satellite dish and air cards. Discussion followed.
 Does passcode for alarm at cabin need to be changed?
Action item: GM needs to look into it.
VII. Next Meeting
 The next BOD meeting will be on July 11, 2012, at 10:00 am.
