Constitution of the State of Sequoyah
Preamble & Bill of Rights
Invoking the blessing of Almighty God and reposing faith in the
Constitution and Treaty obligations of the United States, we, the
people of the State of Sequoyah, do ordain and establish this
Constitution.
ARTICLE I: BILL OF RIGHTS
Section 1. All political power is vested in and derived from the
people; is founded upon their will, and is instituted for the good of the
whole.
Section 2. The people of this State have the right to alter and
abolish their Constitution and form of government whenever they may
deem it necessary to their safety and happiness
Section 3. All persons have an inherent right to life, liberty, the
pursuit of happiness. To give security to these things is the principal
office of the government.
Section 4. All men have a natural and indefeasible right to
worship God according to the dictates of their own conscience.
Section 5. No person can be compelled to support or attend any
place or system of worship or to maintain or support any priest,
minister, preacher, or teacher of any sect, church, creed, or
denomination of religion.
Section 8. No power shall interfere to prevent the free exercise
of the right of suffrage.
Section 9. The courts of justice shall be open to every person. In
criminal prosecutions the accused shall have the right to appear and
defend in person and by counsel; to be confronted with the witnesses
against him; and to a speedy trial by an impartial jury of the country.
Section 10. No person shall be compelled to testify against
himself in any criminal case, nor shall any person be twice put in
jeopardy for the same offense.
Section 13. No person shall, without due process of law, be
deprived of life, liberty or property.
Section 14. Imprisonment for debt shall not be allowed.
Section 16. Excessive bail shall not be required, nor excessive
fines imposed, nor cruel or unusual punishments inflicted.
Section 18. The military shall always be in subordination to the
civil power. No soldier shall, in time of peace, be quartered in any
house without the consent of the owner.
Section 19. No law shall be passed impairing the freedom of
speech. Every person shall be free to say, write or publish, whatever
he will.
Section 20. The people shall be secure in their persons, papers,
homes, and effects, from unreasonable searches or seizures.
Section 21. The right of a citizen to keep or bear arms in the
common defense shall not be questioned.
Section 22. Private property cannot be taken for private use,
with or without compensation, without the consent of the owner.
Section 23. Private property shall not be taken or damaged for
public use without just compensation.
Section 25. Treason against this state can consist only in levying
war against it, adhering to its enemies, or giving them aid or comfort.
Section 26. Slavery shall never exist in this State.
Section 28. The people have the right peaceably to assemble for
their own good, and by petition or remonstrance.
Section 29. All persons are, and shall ever be equal before the
law. No citizen shall ever be deprived of any right privilege, or
immunity on account of race, color or previous condition.
Section 30. All rights not specifically granted to the State by the
terms of this Constitution are reserved to the people.
Section 31. The State of Sequoyah is an inseparable part of the
Federal Union, and the Constitution of the United States is the Supreme
Law of the land.
