Subject: Kulite Semiconductor Products, Inc. REACH Declaration
The European Union (EU) has adopted regulation no.1907/2006, also known as
the REACH (Registration, Evaluation and Authorization of Chemicals) regulation,
which became effective 1st June 2007.
Article 33 of REACH requires manufacturers and importers in Europe to provide
to customers a declaration of any Substances of Very High Concern (SVHCs) on
the candidate list in the articles they sell >0.1% by weight, whether in integrated
systems, spare parts or modules. The candidate list is published by the
European Chemicals Agency (ECHA) in their web-site.
Kulite Semiconductor produces “articles”. Pursuant to Article 7.1 of the
regulation, any producer or importer of articles must register a substance present
in these articles if ALL the following conditions are met:
a) the substance is present in those articles in quantities of more than a total
of 1 ton per year, per producer or importer; AND
b) the substance is intended to be released under normal or reasonably
foreseeable conditions of use; AND
c) the substance has not been already registered for that use.
It is incumbent upon the EU customers to comply with REACH legislation; our
review has shown that our articles currently do not that fall under the current
REACH legislation as shown above. Additionally, a review of the latest
candidate list as of the date of this declaration against our products shows that
our articles DO NOT contain more than 0.1% by weight, any substance on the
Candidate List.
