Introduction
To comply with the Systems Improvement Programme (SIP) and Legislation under Section 71a of the
Development Act 1993, Councils are required to have in place a “Building Inspection Policy”.
Pursuant to Section 59 of the Development Act 1993, Regulation 74 requires “Notice During Building
Work” at the following stages: Regulation 74 :(1)
Except as otherwise determined by the Council, a person proposing to undertake or undertaking
building work on land (or who is in charge of such work) must give Council (a)
(b)
(c)
(d)
one business day’s notice of the commencement of building work on the site; and
one business day’s notice of the commencement of any stage of the building work
specified by the Council by notice in writing to the building owner on or before
development approval is granted in respect of the work; and
one business day’s notice of the intended completion of any stage of the building work
specified by the Council by notice in writing to the building owner on or before
development approval is granted in respect of the work; and
one business day’s notice of completion of the building work.
(2)
If a licensed builder has not been engaged to undertake the building work, a notice under
subregulation (1)(a) must include the name, address and telephone number of the person who is
proposed to provide any written statement required under regulation 83(2) (a) or (b).
(3)
A notice by a person under subregulation (1) may be given :(a) by leaving a written notice with a duly authorized officer of the Council; or
(b) by posting it to the Council; or
(c) by telephone.
(4)
If notice is given under subregulation (3)(d), the Council must make a note recording the receipt of
the notice on the relevant file.
In compliance with this current legislation the Development Officer applies all or part thereof of the
following “Mandatory Notification to Council” as conditions of approval to almost all Development
Approvals.

Mandatory Notification to Council
The applicant is advised that pursuant to Regulation 74(1) of the Development Act 1993, Council requires
mandatory notification of the following stages of the building work:
(a)
(b)
(c)
one business day’s notice of the commencement of building work on the site
one business day’s notice prior to the commencement of :
i.
excavation or location of fill on a site
ii.
placement of concrete in any footing, pad or floor slab
iii.
placement of any assembled or partly assembled transportable structure on a site
one business day’s notice of the completion of :
i.
walls and/or roof framing prior to installation of lining materials
ii.
building work prior to occupancy
iii.
work on a swimming pool and associated safety fencing
iv.
wet area flashings or sealants
NOTE :- Fines may be incurred for non-compliance with this condition.
Class 1 & 2 Buildings (and associated Class 10 Buildings & Structures)
Notifications
Pursuant to Section 59 of the Development Act 1993, Council will require the following
notifications:




one day’s notice of commencement of building work on the site
one day’s notice of the commencement of pouring of footings
one day’s notice of the completion of cavity masonry walls
one day’s notice of the completion of the building work
one day’s notice of the completion of installation of safety barriers (prior to a
swimming pool being filled with water)
Audit Inspections
Pursuant to Section 71A of the Development Act 1993, Council will inspect 10% of all
development approvals issued, including developments where the Building Rules Consent has
been issued by a Private Certifier, Council will carry out audit inspections at least at one of the
following stages.






at pouring stages
NOTE : If footings are designed by an engineer, Council may accept a
certificate from the design engineer confirming compliance otherwise provide
audit inspections.
at completion of wall and roof framing
at completion of masonry walls
on completion of building work; and
where a swimming pool is to be constructed, on completion of installation of
safety barriers (prior to the swimming pool being filled with water).

Class 3 - 9 Buildings
Notifications
Pursuant to Section 59 of the Development Act 1993, Council will require the following
notifications :






one day’s notice of commencement of building work on the site
one day’s notice of the completion of the building work; and as relevant
one day’s notice of the commencement of pouring of the footings
one day’s notice of the commencement of pouring of a suspended floor slab
one day’s notice of the completion of masonry walls
one day’s notice of the completion of wall and/or roof framing
Audit Inspections
For commercial and industrial buildings sites, Council will perform audit inspections on 20% of
development approvals issued, including developments where the Building Rules Consent has
been issued by a Private Certifier, Council will carry out audit inspections at least at one of the
following stages:

on completion of walls, floors, roof framing, inspections;
on completion of fire or smoke separation.
Follow up inspections shall be at the discretion of the development officer inspecting the particular site.
Council will require a certificate of inspection from the design engineer on all suspended slabs.
