LETTER OF AGREEMENT- THIRD PARTY SPECIAL EVENTS
This is a letter of agreement between the Ontario Lung Association (OLA) and _____________________(the
Organizer) who wishes to organize a special event through the Lung Champion program with a portion of the
proceeds going to the OLA. Specifically, the Organizer is planning to hold a __________________________
event (hereinafter called “the Event”) in the community of _______________________on or about
__________________________, 2013 as outlined in the application submitted to the OLA on_________2013.
The undersigned agrees to carry out the Event under the following conditions:
1. The OLA assumes no legal or financial liability associated with or arising from the Event.
2. The Organizer releases and indemnifies the OLA from any loss of property, accidents that necessitate
medical attention, or any damage resulting at or from the Event and any costs arising therefrom.
3. Because funds entrusted to the OLA cannot be risked in projects managed by others, the OLA is unable to
provide “seed” money or to reimburse costs of running third-party events.
4. The Organizer is required to access and receive appropriate legal permits and licences prior to their
Event.
5. The OLA authorizes the Organizer to use its name and the Lung Champion logo in promotional materials
and communications related to the Event on condition that all publicity whether printed or online be
presented to and approved by the OLA before its use.
6. Any and all tax receipts for eligible donations received will be issued exclusively by the OLA. The OLA will
advise the Organizer about Canada Revenue Agency regulations regarding charitable tax receipts. In the
event that the tax receipt is to be issued for a portion of the donor’s cost to participate in the Organizer’s
event, the OLA reserves the right to request a financial report to verify the receiptable amount.
7. The OLA authorizes the Organizer to use the Lung Champion online fundraising portal for the purposes of
the Event. When using the online fundraising portal, the Organizer agrees to abide by all Lung
Champions Website Terms and Conditions stated as set out in Appendix A, attached.
8. The Organizer will not have access to any of the funds raised through the Lung Champion online
fundraising portal since they will automatically be entered into the OLA system. A tax receipt will be issued
automatically to the donor for online donations of $20 or more.
9. Participation by OLA staff and volunteers will be voluntary and should not be a critical element in the
success of the event.
10. The Organizer will immediately notify the OLA of any changes to the nature of the event and/or date or its
cancellation.
11. The OLA reserves the right to cancel this Agreement and the use of its name and/or website in the event
that the Event is cancelled or if the OLA has serious concerns about the way the project is being
implemented. Should such circumstances occur, the Organizer will be provided 24 hours’ notice. The
OLA is not responsible for financial or other damages that may result from this cancellation.

Appendix A
1. Lung Champions Website: Terms and Conditions of Use By viewing or uploading content to this
website, you are agreeing to: these Terms and Conditions; the copyright notice; and the privacy policy.
2. This website is owned and operated by the Ontario Lung Association (OLA). The OLA may update these
Terms and Conditions at any time without notice to you. Please review these Terms and Conditions from
time to time, as your continued website usage will mean that you accept these changes.
3. Upon acceptance of these Terms and Conditions, permission is granted for you to temporarily view, copy,
print or download a copy of the material on this site solely for your personal, non-commercial use.
4. The Lung Champions website is designed to assist you in your efforts to fundraise through an event to
benefit the OLA, and its content is subject to change without notice and at the sole editorial discretion of
the OLA.
5. While the OLA follows specific procedures to ensure the accuracy and reliability of its website content, your
use of this service is at your sole risk.
6. In no event will the OLA be responsible for damage sustained by any visitor to the site resulting from
infection, contamination or other destructive property passed on to the visitor's computer system as a result
of visiting, copying or downloading from the site.
Uploading Content to the Lung Champions Website
7. This website encourages users to upload a photo of someone (or a group of individuals) at or preparing for
a Lung Champion event (in .jpg, .gif or .png format with a maximum size of 2MB);
8. The OLA (or its designate) will vet content submitted through this website. It is at the sole discretion of
OLA whether or not submitted content will be posted to the website. Those submitting content to this
website may be contacted to provide further background.
9. To upload content to this website, users must:
a. be at least 18 years of age;
b. agree to abide by these Terms and Conditions; and
c. comply with all local rules, regulations and laws regarding online conduct and acceptable content.
10. Images submitted must have been taken with the permission of the subject and not infringe the copyright
of any third party or any laws.
11. By submitting content to this website, users grant a worldwide licence to OLA to use the images and
captions in any way deemed fit (e.g. to feature any or all of the submitted images, videos or written
material on their websites and/or in any materials they develop for media, health care professionals or
patients, with acknowledgement of the submitter). Users may be contacted to provide further background
to the content and will be notified ahead of use beyond the Lung Champions website. Submitted content
will be used to highlight the impact that community engagement has on the understanding and awareness
