Issuance of the certificate ofperformance of environment protection works
serving the operation phase
a) Order of execution:
Step 1: Submitting the dossier: The project owner submits the dossiers at the
Section for receiving and delivering results (also called One - Stop Office) of Dong
Nai Industrial Zones Authority.
Step 2: Checking the dossier: Dong Nai Industrial Zones Authority is
responsible for checking the validity and content of the dossiers.
Step 3: Conducting to inspect and issuing certificate.
- The inspection of environment protection works serving the operation
phase shall be carried out via the Inspectorate established byDong Nai Industrial
Zones Authority.
- The inspectorate verifies the applicationand takes part in physical
verification activities relating to completion of environment protection
works.The inspection result of environment protection works must be made in
the form of inspection record.
- According to the inspection result, if the environment protection work
serving the operation phase conforms to the approved EIA report and the written
approval for amendments issued by the EIA-report approving authority (if any),
Dong Nai Industrial Zones Authority shall issue the certificate of completion of
environment protection works serving the operation phase. If the environment
protection work serving the operation phase does not satisfy the
requirements,Dong Nai Industrial Zones Authority shall send a notification to
the project owner.
- The project owner must eliminate shortcomings of the environment
protection works serving the operation phase and send a report toDong Nai
Industrial Zones Authority for consideration and approval.
Working time:
- From 07:00 am to 11:30 am.
- From 01:00 pm to 04:30 pm.
(Except Saturday, Sunday and holidays).
b) Mode of execution:
- Directly submit at One-Stop office of Dong Nai Industrial Zones
Authority;
- Send by post.
c) Components and number of dossiers:
Components of a dossier shall comprise:
- One (01) application form for inspection and certification of completion
of environment protection works using the form prescribed in Appendix 3.1. of
this Circular;

- One (01) copy of the decision on approval enclosed with the copy of the
approved EIA report;
- Seven (07) reports on performance of environment protection works
serving the operation phase using the form prescribed in Appendix 3.2. of this
Circular; If the project is carried out in at least 02 central-affiliated cities and
provinces, the project owner must provide additional reports for inspection;
+ If the project has a number of investment stages or independent items, the
project owner may prepare report on performance of environment protection
works serving the operation phase for each investment stage or each
independent item provided that all environment protection works serving the
operation phase of each investment stage or each independent item are
completed;
+ Regarding the project having the EIA report which is approved as
prescribed in Law on Environment protection dated 1993 or Law on
Environment protection dated 2005 but it is not mentioned in the list prescribed
in Column 4 Appendix II of Decree 18/2015/NĐ-CP, the project owner shall be
exempt from responsibility for preparation of report on performance of
environment protection works serving the operation phase.
d) Processing time:
- Deadlines for examining, answering for the validity and content of the
dossier: Within 05 working days from the date of receiving.
- Deadlines for issuance of confirmation of finished environment protection
works:
+ Within 15 working days from the date on which the report on operation
of environment protection works serving the operation phase of the project is
received if it is not required to collect samples or analyze environmental
parameters for verification;
+ Within 30 working days from the date on which the report on operation
of environment protection works serving the operation phase of the project is
received if it is required to collect samples or analyze environmental parameters
for verification;
e) Subjects executing administrative procedures: The project owner.
f) Agencies executing administrative procedures:
-The competent agency making decisions stipulated by law: Dong Nai
Industrial Zones Authority.
- The direct agency executing administrative procedures: Dong Nai
Industrial Zones Authority.
g) Name of application forms, declaration forms:
- Format of cover and appendixes of reports on performance of
environment protection works serving the operation phase.

- Format of reports on performance of environment protection works

(according to Apendixes 2.12, 3.1 and 3.2 Circular No. 27/2015/TTBTNMT dated May 29, 2015by the Minister of Natural Resources and
Environment).
h) Result of executing administrative procedures: Certificate of
performance of environment protection works serving the operation phase.
i) Requirements and conditions for executing administrative
procedures: None
j) Legal basis of administrative procedures:
- Law on Environmental Protection No. 55/2014/QH13;
- Decree No.18/2015/NĐ-CP dated February 14, 2015 by the Government
on environmental protection assessment, strategic environmental assessment,
environmental impact assessment and environmental protection plans;
- Circular No. 27/2015/TT-BTNMT dated May 29, 2015 by the Minister of
Natural Resources and Environment on strategic environmental assessment,
environmental impact assessment and environmental protection plans;
- Decision No. 57/QD-UBND dated January 12, 2015 by Dong Nai
People’s Committee on authorizing General Director of Dong Nai Industrial
Zones Authority to arrange to verify the report on EIA; detailed environmental
protection project for the establishment located in industrial zones in the
province.
