PRICE DIFFERENTIALS
LAWS AND RULES

The following laws and rules apply to
wholesale malt price differentials, or,
change of prices:
Floida Statute 563.065 Price differentials.--Nothing in the Beverage Law shall
prohibit licensed distributors of malt beverages from charging different malt beverage prices according to county, according
to the branch of a distributor's parent place
of business, according to whether a vendor sells malt beverages on premises or
off premises, or according to quantity sold,
as long as the price differentials are filed in
advance with the Department of Business
and Professional Regulation as provided
by rule.
Florida Administrative Code 61A-4.013
Malt Beverages, Differential Prices or
Change of Prices.
(1) If a manufacturer or distributor of malt
beverages shall establish differential prices or change of prices on such beverages
according to the quantity sold, such manufacturer or distributor must file the differential prices or changes of prices with the
Division giving ten (10) days notice before
change of price becomes effective.
(2) If any such manufacturer or distributor
operates branches and maintains a price
structure that establishes different prices
in said branches than the prices established at the parent place of business,
price list for such branches and the parent
place of business must be filed with the
Division.
(3) If any such manufacturer or distributor
establishes price differentials on the same
quantity but in different counties, price lists
should be filed by county.

Malt Beverage Price Postings Now
Online!
Malt beverage price changes must be
filed with the Division of Alcoholic Beverages and Tobacco at least ten days before the prices become effective. To assist
you with this requirement, wholesale distributors may now elect to submit these
changes online.
The price posting form may be downloaded from the Internet, and when completed, may be e-mailed to the Division. Instructions for electronically submitting the
malt beverage price postings are on the
next page.
INSTRUCTIONS FOR COMPLETING
PRICE DIFFERENTIAL NOTICE FORM
1. To obtain the notice form, log onto the
Internet at:

2. Choose form Notice of Differential Prices
or Change of Prices (Malt Beverages)
ABT 4000A-032E (.doc format).
3. Fill in the notice form. If space is needed
for more than one brand, then while in the
last column (Cash Price After Posting),
press the TAB key. Or, click outside the
table, ensuring the insertion point is immediately under the current table. From
the Toolbar, click “Table,” “Insert Rows,”
and enter the number of rows desired.
The Division will review requests for malt
beverage price changes daily. Upon approval, we will post all approved requests
on the Internet for viewing at:
