WAIVERANDRELEASEFROMLIABILITY
InconsiderationofbeingallowedtoparticipateintheKVKL:
IHEREBYWAIVEANDRELEASE,indemnify,holdharmlessandforeverdischargeKawValleyKickball
League(“KVKL”),anditsagents,employees,officers,directors,affiliates,successorsandassigns,ofandfromany
andallclaims,demands,debts,contracts,expenses,causesofaction,lawsuits,damagesandliabilities,ofevery
kindandnature,whetherknownorunknown,inlaworequity,thatIeverhadormayhave,arisingfromorinany
wayrelatedtomyparticipationinanyoftheeventsoractivitiesconductedby,onthepremisesof,orforthe
benefitof,KVKLprovidedthatthiswaiverofliabilitydoesnotapplytoanyactsofgrossnegligence,orintentional,
willfulorwantonmisconduct.
IunderstandthattheactivitiesinwhichIwillparticipateareinherentlydangerousandmaycauseserious
orgrievousinjuries,includingbodilyinjury,damagetopersonalproperty,temporaryorpermanentdisability,
and/ordeath.Onbehalfofmyself,myheirs,assigns,administrators,executorsandnextofkin,Iwaiveallclaims
fordamages,injuriesanddeathsustainedtomeormypropertythatImayhaveagainsttheaforementioned
releasedpartytosuchactivity,includingclaimsintort,contract,equityorotherwise.Iintendthiswaivertoapply
toallrisksinvolvedinKVKLactivities,whetherknownorunknown.
Iacknowledge,agree,andrepresentthatIunderstandthenatureofKVKLactivitiesandthatIamqualified,
ingoodhealth,andinproperphysicalconditiontoparticipateinsuchactivities.Ifurtheragreeandwarrantthatif
atanytimeIbelieveconditionstobeunsafe,Iwillimmediatelydiscontinuefurtherparticipationintheactivity.
Asateamcaptain,IwillnotallowanypersontoparticipateinKVKLactivitiesiftheyhavenotsigneda
KVKL2017PlayerRelease(“UnqualifiedTeamMember”).Furthermore,Iherebyassumefullresponsibilityforand
indemnifyKVKLfromanyclaimsorliability,includingattorney’sfees,associatedwithanUnqualifiedTeam
MemberbeinginjuredwhileparticipatinginaKVKLactivity.AsteamcaptainIhavereadandunderstandtheKVKL
rulesandcodeofconduct.
BythisWaiver,Iassumeanyrisk,andtakefullresponsibilityandwaiveanyclaimsofpersonalinjury,
deathordamagetopersonalpropertyassociatedwithKVKL,includingbutnotlimitedtopracticingand/or
engagingandcompetinginanycompetitionsorotheractivitiesandusingthepremisesandfacilitiesand
equipmentinanymanner,formorfashion.
IdoherebygiveKVKLtheirassigns,licenses,andlegalrepresentativestheirrevocablerighttousemy
name[oranynickname],picture,portrait,photograph,image,orvoiceinallformsandmediaandinallmanners,
includingcompositeorpurpose,andIwaiveanyrighttoinspectorapprovethefinishedproduct,includingwritten
copy,thatmaybecreatedinconnectiontherewith.IalsoagreethatthisreleasesKVKLandanyandallofits
representativesfromanyandallmonetaryobligationsorpaymentstomeoranyorallofmyauthorized
representativesforuseofvideo,films,photographs,imageand/orvoiceofmyself.
ThisWAIVERANDRELEASEcontainstheentireagreementbetweentheparties,andsupersedesanyprior
writtenororalagreementsbetweenthemconcerningthesubjectmatterofthisWAIVERANDRELEASE.The
provisionsofthisWAIVERANDRELEASEmaybewaived,altered,amendedorrepealed,inwholeorinpart,only
uponthepriorwrittenconsentofallparties.
TheprovisionofthisWAIVERANDRELEASEwillcontinueinfullforceandeffectevenafterthe
terminationoftheactivitiesconductedby,onthepremisesof,orforthebenefitofKVKL,whetherbyagreement,
byoperationoflaw,orotherwise.
Ihaveread,understandandfullyagreetothetermsofthisWAIVERANDRELEASE.Iunderstandand
confirmthatbysigningthisWAIVERANDRELEASEIhavegivenupconsiderablefuturelegalrights.Ihavesigned
thisAgreementfreely,voluntarily,undernoduressorthreatofduress,withoutinducement,promiseorguarantee
beingcommunicatedtome.Mysignatureisproofofmyintentiontoexecuteacompleteandunconditional
WAIVERANDRELEASEofallliabilitytothefullestextentpermittedbylaw.Iam18yearsofageorolderand
mentallycompetenttoenterintothiswaiver.
