Providing Workforce Investment Act (WIA) services to applicants and complying
with the Selective Service rules for registration.
PURPOSE
To ensure that each individual participating in any WIA program or activity or receiving any
assistance or benefit has not violated section 3 of the Military Selective Service Act (50 USC Sec.
453) by not registering for the draft.
BACKGROUND
As stated in Section 189 (h) of the Workforce Investment Act of 1998 (PL 105-220), Selective
Service registration is a prerequisite for WIA participation. Therefore RWBs and other
subgrantees must confirm Selective Service registration status if the individual does not have
proof of registration.
Males who are 18 but not yet 26 years old must register with the Selective Service. The universal
draft registration requirement also applies to immigrant male aliens, whether legally admitted to
the United States, newly legalized persons under the Immigration Reform and Control Act of 1986
(IRCA), or illegal aliens. In those instances where the individual is now twenty-six years of age or
older and has failed to register, a request for a Status Information Letter from the Selective
Service System (SSS) may be made on-line or inquiries may be addressed to: Selective Service
System, P.O. Box 94638, Palatine, Illinois 60094-4638.

The response from the SSS may indicate that the individual has shown that his failure to register
was not knowing and not willful. There may also be other extenuating circumstances that must be
taken into consideration locally before a determination to serve the individual is made. It is the
RWBs and other subgrantees, not the Selective Service, that have the final decision as to whether
WIA services are to be provided. Documentation should be maintained in these cases. The
individual does have the right to file a grievance should he disagree with the RWBs’ final decision.
Registration may be verified on-line via the Internet at http://www.sss.gov/. Individuals who have
not registered may also register on-line at this same site. A record of this registration can be kept
in the applicant’s file as documentation of Selective Service registration. In summary, the
