THORNBURY HOMEOWNERS ASSOCIATION
POOL AND RECREATIONAL FACILITIES RULES
1.
Facility users will be required to register with the lifeguard at the pool upon the first use
of the pool during the season. Registration of each family member and the ages of
children are required.
2.
Identification is necessary to gain admission to the pool and cabana area, which is open
from Tuesday through Sunday. Facility users are allowed in the pool and cabana area
only when a lifeguard is on duty. Except for separate rental of the facilities pursuant to
the rules on the attached form, use of the pool and bath house area at any other time than
the following hours is not permitted:

The pool may be closed for maintenance, health conditions, weather conditions or due to
any other reason deemed necessary by the lifeguard or pool management.

The lifeguard and pool management possess total authority on behalf of the homeowner’s
association manager and trustees during periods of pool and recreational facilities
operation. The lifeguard may exercise discretion in the determination of appropriate
behavior and conduct by facilities users and prohibit use or remove users as warranted.
Any activity which is dangerous and/or potentially destructive to any individual or to the
pool, cabana structure, furniture, appliances or any other item in the pool and cabana area
is strictly prohibited, and the lifeguard has absolute and final authority to ban such
conduct.

No smoking within the swimming pool area.
5.
Admission to the pool and cabana area and use of the sport court is limited to Thornbury
residents and their guests. A maximum of four (4) guests per household are permitted.
Guests wishing to use the pool and cabana must be in the company of their host/resident,
who is responsible for their conduct.
6.
Admission to the pool and cabana area will be refused to any person having a contagious
disease, infectious condition, serious illness or related condition.
7.
Admission to the pool and cabana area will be refused to any resident in arrears in the
payment of any assessment or fees.

Children under the age of THIRTEEN (13) must be supervised at all times by a person at
least TWENTY ONE (21) years of age, with no more than 4 children under that person’s
supervision unless accompanied by a parent. The lifeguard may determine that a child’s
supervision is inadequate and require the child to leave the pool and cabana area. In
addition, if required by the lifeguard, any swimmer must pass a swimming test before
being allowed in the deep end of the pool. They must demonstrate during the swimming
test the ability to swim one width of the pool and tread water for at least thirty (30)
seconds.
9.
Horseplay, including but not limited to running, splashing, rough play, shoving or
dunking, is not permitted. No diving, jumping in backwards or flips from the sides of the
pool. Throwing of objects, such as tennis balls, balls or rocks, is not permitted.
10.
Profanity, improper behavior and intoxication by facilities users are not permitted.
Excessive noise, including the use of radios, boomboxes or other audio devices, is not
permitted.
11.
Bicycles, skateboards, skates, roller blades, scooters, or other wheeled recreational items
are not allowed in the pool and cabana area or on sport court. This restriction does not
apply to handicap devices.
12.
Swimmers who can swim only with the aid of a flotation devise must remain in the
shallow end of the pool at all times. Non-swimming children must be supervised at all
times.
13.
Loitering in the pool and cabana area and on the sport court is not permitted.
14.
Only swimming apparel is permitted in the pool.
15.
Air mattresses, beach balls, Frisbees, and other swimming accessories are permitted in
the pool ONLY during low usage times and at the discretion of the lifeguard.
16.
No dogs or other pets are permitted in the pool, cabana or the sport court.
17.
Neither the lifeguard, pool management nor the trustees assume responsibility for
personal belongings lost or damaged in the pool and cabana area or on the sport court.
18.
Facilities users are required to dispose of all trash.
19.
No glass items of any kind are allowed in the pool, cabana or sport court.
20.
Food and drink may be brought into the pool area, but it is to be kept 10 feet away from
the pool.
