Conditions of Hire
1.
Equipment Hired:
The Customer hires the equipment specified on the Hire Contract from HireQuip cc; HireQuip is the owner of the equipment.
HireQuip does not warrant the equipment as suitable for any particular purpose and the customer shall have no claim against
HireQuip for any failure of the equipment to meet his needs. HireQuip reserves the right to reclaim the equipment from the
customer for maintenance thereof or due to breach of this contract or for any other reason, and shall not be liable for any loss
that may as a consequence be suffered by the customer.

Responsibility for Equipment:
The customer is responsible for the equipment while it is on hire.

The customer is required to insure the hire equipment.

The equipment is deemed to be in good condition and the customer will maintain the equipment at his cost while it is on
hire.

The customer understands the correct method of operating the equipment and will adhere to this.

In the event of equipment breakdown, the customer will forthwith advise HireQuip.
3.
Charges:
The customer shall be charged at the daily rate specified on the Hire Contract from the commencement of the hire until the
equipment is accepted as returned by HireQuip. A part day will be charged as a full day. HireQuip may at its discretion issue
invoices for hire charges at weekly or less frequent intervals, and these invoices are payable immediately by the customer. The
deposit made at the commencement of the hire will be refunded to the customer, or deducted from amounts due when hire is
completed. Any overdue amounts will be subject to interest at the prime overdraft rate.

Use of Equipment:
The customer is responsible for the correct usage of the equipment and indemnifies HireQuip for any loss or damage which
may arise if the equipment is not used in the correct manner. The customer indemnifies HireQuip against any claims that may
arise from the use of the equipment while it is on hire to him.

Jurisdiction:
The customer consents to the jurisdiction of the Pretoria Magistrate’s Court for any claim arising out of this agreement. The
customer’s domicilium citandi et executandi is shown on the Hire Contract.

Legal Proceedings:
6.1
Should HireQuip cc have to institute legal proceedings against the customer and /or the surety as the case may be, for
the recovery of the equipment and/or replacement value thereof, and/or any amount(s) due to HireQuip for the hire of
its equipment, in any competent Magistrate’s Court in South Africa, then HireQuip cc shall be entitled to recover
such costs as incurred on the attorney and client scale.
6.2
Should HireQuip cc have to institute proceedings in any competent high Court in South Africa, then it shall be
entitled to recover such costs as incurred on the attorney and own client scale.
6.3
A certificate of balance signed by the Manager of HireQuip cc, or a member of the Close Corporation whose
authority need not be proved, shall be conclusive proof of the customer’s and/or surety’s indebtedness to HireQuip
cc, as the case may be.
6.4
Tracing cost and/or charges: In the event of HireQuip çc having to trace the customer and incur tracing cost from
time to time, HireQuip cc will be entitled to recover such cost incurred from the customer in the event of legal
proceedings being instituted.
Suretyship:
The person signing these conditions of hire hereby binds himself as surety and co-principle debtor, jointly and severally with
the customer, for the due performance of the customer’s OBLIGATIONS.
Pursuant to these conditions of hire, the aforesaid partner hereby specifically renounces the excussion as well as all other legal
exceptions available to him in law.
