Article III, Section 3: Treason 1: Treason against the United States, shall consist only in levying war against them, or in adhering to their enemies, giving them aid and comfort. No person shall be convicted of treason unless on the testimony of two witnesses to the same overt act, or on confession in open court. Basically, treason is the only crime that is actually defined specifically in the Constitution. The criteria for treason conviction cannot be changed in any ways whatsoever, and for one to be convicted of treason, two witnesses must give a testimony to the same conspicuous act, or if the offender makes a confession in court. 2: The Congress shall have power to declare the punishment of treason, but no attainder of treason shall work corruption of blood, or forfeiture except during the life of the person attainted. Often based on the level of treason itself, Congress can determine a wide range of penalties for treason. They are from a minimum of 5 years in prison, and a $10,000 fine, and a maximum of the death penalty. No one convicted of treason has been executed in the United States, although a few have been condemned to death, like Daniel Shays, the farmer whom led a rebellion, and was afterwards convicted of treason and put onto death row. However, he was eventually pardoned.
