Indian Penal Code
● Section 268 - Public nuisance:
Note: This section states that a person will be guilty of public nuisance when he/she commits an
act which causes injury or annoyance to either the public at large, or the people who occupy a
specific area. This can be relied on if there is any cruelty committed in your neighbourhood
which disturbs the whole locality.
A person is guilty of a public nuisance who does any act or is guilty of an illegal omission which
causes any common injury, danger or annoyance to the public or to the people in general who
dwell or occupy property in the vicinity, or which must necessarily cause injury, obstruction,
danger or annoyance to persons who may have occasion to use any public right.
A common nuisance is not excused on the ground that it causes some convenience or advantage.
● Section 269 - Negligent act likely to spread infection of disease dangerous to life:
Note: This section states that a person who illegally or carelessly does anything which spreads
or has the potential to spread any infectious, fatal disease, is punishable with imprisonment of a
maximum period of six months or fine, or both.
Whoever unlawfully or negligently does any act which is, and which he knows or has reason to
believe to be, likely to spread the infection of any disease dangerous to life, shall be punished
with imprisonment of either description for a term which may extend to six months, or with fine,
or with both.
● Section 270 - Malignant act likely to spread infection of disease dangerous to life:
Note: This section states that a person who commits any dangerous act which spreads or has the
potential to spread any infectious, fatal disease, is punishable with imprisonment of a maximum
period of two years or fine, or both.
Whoever malignantly does any act which is, and which he knows or has reason to believe to be,
likely to spread the infection of any disease dangerous to life, shall be punished with
imprisonment of either description for a term which may extend to two years, or with fine, or
with both.
● Section 378 - Theft:
Note: This section regard theft of property, also applies to theft of another person’s animals.
Where an animal is taken without the responsible person’s consent, will amount to theft.
Explanation 4 specifically refers to a thief who induces animals to move.
The illustrations appended give examples of animals being used in situations of theft.
Whoever, intending to take dishonestly any moveable property out of the possession of any
person without that person's consent, moves that property in order to such taking, is said to
commit theft.
Explanation 4- A person, who by any means causes an animal to move, is said to move that
animal, and to move everything. which, in consequence of the motion so caused, is moved by
that animal.
Illustrations.
(b) A puts a bait for dogs in his pocket, and thus induces Z's dog to follow it. Here, if A's
intention be dishonestly to take the dog out of Z's possession without Z's consent. A has
committed theft as soon as Z's dog has begun to follow A.
(c) A meets a bullock carrying a box of treasure. He drives the bullock in a certain direction, in
order that he may dishonestly take the treasure. As soon as the bullock begins to move, A has
committed theft of the treasure.
● Section 379 - Punishment for theft:
Note: This section states that anyone who commits theft will be punished with either
imprisonment for a maximum period of three years, or fine, or both.
Whoever commits theft shall be punished with imprisonment of either description for a term
which may extend to three years, or with fine, or with both.
● Section 428 - Mischief by killing or maiming animal of the value of ten rupees:
Note: This section states that the crime of mischief by way of killing or maiming an animal, the
value of which is Rs. 10 or more than Rs. 10, will be punishable with either imprisonment for a
maximum period of two years, or fine, or both.
Whoever commits mischief by killing, poisoning, maiming or rendering useless any animal of
the value of ten rupees or upwards, shall be punished with imprisonment of either description for
a term which may extend to two years, or with fine, or both.
● Section 429 - Mischief by killing or maiming cattle, etc., of any value or any animal
of the value of fifty rupees:
Note: This section states that the crime of mischief by way of killing or maiming an animal, or
doing any act which will make the animal useless for the purpose humans were using it, will be
punishable with either imprisonment for a maximum period of two years, or fine, or both.
Whoever commits mischief by killing, poisoning, maiming or rendering useless, any elephant,
camel, horse, mule, buffalo, bull, cow or ox, whatever may be the value thereof, or any other
animal of the value of fifty rupees or upwards, shall be punished with imprisonment of either
description for a term which may extend to five years, or with fine, or with both.
● Section 503 - Criminal intimidation
Note: This section states that any person who threatens or intimidates another person for any act
which they are legally entitled to do, will be guilty of criminal intimidation. This section enables
activists or animal welfare organizations who are being threatened by other people to stop
taking care of animals, which is their Constitutional right to do, can file a case against such
persons for criminal intimidation.
Whoever threatens another with any injury to his person, reputation or property, or to the person
or reputation of any one in whom that person is interested, with intent to cause alarm to that
person, or to cause that person to do any act which he is not legally bound to do, or to omit to do
any act which that person is legally entitled to do, as the means of avoiding the execution of such
threat, commits criminal intimidation.
Explanation- A threat to injure the reputation of any deceased person in whom the person
threatened is interested, is within this section.
Illustration
A, for the purpose of inducing B to desist from prosecuting a civil suit, threatens to burn B's
house. A is guilty of criminal intimidation.
