‫‪Law and Economic Development: Historical Perspectives‬‬

‫השאלה מדוע מדינות מסוימות (מערביות או צפוניות) עברו תיעוש וצמיחה כלכלית מהירה והגיעו לרמת חיים‬
‫גבוהה ומדינות אחרות (מזרחיות או דרומיות) נותרו מאחור מטרידה חוקרים מתחומי ידע שונים מזה עשרות‬
‫שנים‪ .‬לאחרונה חוקרים רבים מייחסים להבדלים במוסדות‪ ,‬יותר מאשר להבדלים במשאבים או בפיתוח‬
‫טכנולוגיה‪ ,‬חלק מכריע בהסבר‪ .‬ייחוס חשיבות למוסדות הוביל לייחוס חשיבות למשפט‪ .‬בשנים האחרונות‬
‫גדל מספר חוקרים סוברים כי המפתח לקידמה הוא ביסוס שלטון החוק‪ ,‬מלחמה בשחיתות‪ ,‬הגדרת זכויות‬
‫קניין פרטיות והגנה עליהן והנהגת חופש חוזים‪.‬‬
‫בקורס נכיר עבודות עכשוויות בעיקר מתחומי הכלכלה (כלכלה המוסדית וההיסטוריה הכלכלית)‪ ,‬המשפט‬
‫(היסטוריה משפטית ומשפט וכלכלה) וההיסטוריה העוסקות בשאלות אלו‪ .‬נדון בין היתר בשאלות הבאות‪:‬‬
‫האם הגנה על זכויות קניין מקדמת צמיחה או מנציחה חלוקת משאבים לא שוויונית? האם שיטות המשפט‬
‫המקובל יציר הפסיקה או שיטות המשפט הקונטיננטלי המבוסס על קודיפיקציה תומכות יותר בהתפתחות‬
‫כלכלית? מה מקומן של נורמות חברתיות בתהליכי מודרניזציה? האם ניתן להבנות שיטה משפטית "מלמעלה"‬
‫או לשתול שיטה במשפטית מוצלחת במדינה פחות מפותחת כדי לקדמה?‬
‫בחלקו הראשון של הקורס נציג גישות תיאורטיות שפותחו כדי לדון בשאלות אלו‪ ,‬בחלקו השני ניישם גישות‬
‫אלו ביחס לכמה מקרים היסטוריים שיילקחו מתקופות שונות‪ ,‬תחומי משפט שונים‪ ,‬ומדינות שונות‪ ,‬בחלקו‬
‫השלישי נדון בתיזות כלליות על הקשר בין המשפט לבין צמיחה והתפתחות כלכלית‪.‬‬
‫רבים מ המאמרים נגישים בצורה אלקטרונית במאגרי הטקסט לפי האות המצויינת בצד הפריט‪ .‬הם הועלו גם‬
